Fahad Shabbir, of L E Taxis in Long Eaton, was prosecuted by Erewash Borough Council after his private hire vehicle was taken for an inspection in April this year. During that inspection at the council’s depot in Merlin Way, Ilkeston, workers found that the vehicle's MOT had expired six weeks beforehand. As a result, magistrates fined him a total of £266. Councillor Garry Hickton, lead member for Environment at Erewash Borough Council, says: “This was a licenced private hire vehicle that had been used 300 times during that time to take members of the public on their journeys. “It is therefore vital that the correct tests and checks should have been carried out to ensure the safety of passengers and drivers. “This successful prosecution sends out a clear message that we will take action against media release companies and individuals that have not had these relevant checks and tests completed on time.” Mr Shabbir, of St. James Road, Derby, pleaded guilty to driving or allowing another to drive a motor vehicle on a road without a valid MOT. At the conclusion of the case, at Southern Derbyshire Magistrates’ Court on September 5, he was fined £121, made to pay a victim surcharge of £30 and costs of £115 to the council. It is a criminal offence to drive a vehicle without a valid MOT certificate. |

Note that another newspaper reports the same story as the private hire *operator* being fined, and not necessarily the driver of the vehicle. Suspect he was prosecuted as the owner/proprietor of the vehicle rather than as a private hire *operator*, although suspect the above article which portrays him as the *driver* isn't necessarily totally accurate. Taxis in Long Eaton, admitted driving or allowing another to drive a motor vehicle on a road without a valid MOT test certificate, contrary to section 47 of the Road Traffic Act 1988. He was fined £121 at Southern Derbyshire Magistrates' Court on September 5. The car had been used to make 300 journeys during the time it was on the road without an MOT certificate. The offence was discovered when the vehicle was taken for inspection at Erewash Borough Council's depot in Merlin Way, Ilkeston. The licencing team noticed its MOT had expired six weeks earlier. LO a bit slow to respond there A driver was found to have made around 300 journeys in his taxi without a valid MOT certificate. |
