Taxi driver who left scene of accident spared ban by licensing chiefs

https://www.theboltonnews.co.uk/news/16 ... ng-chiefs/

A TAXI driver has been let off with a warning by licensing chiefs despite his conviction for driving without due care and attention and failing to stop after an accident.

Bolton Council’s licensing committee heard that the cabbie had been convicted of the offences after an incident in August last year, resulting in him being hit with a fine and penalty points.

These are considered “major offences” under council policy.

But the traffic offences sub-committee found the driver’s evidence was “truthful and remorseful”.

Minutes from the hearing, held at Bolton Town Hall, add: “The driver gave detailed evidence of the incident and stated that only slight damage had been caused to the other vehicle.

“Members viewed pictures of the slight damage that had been caused to the vehicle and therefore agreed to issue him with a warning letter on this occasion.”

The driver had also declared the conviction as required.

The meeting was chaired by Cllr Sue Haworth. Councillor Martin Donaghy, Paul Wild and Stuart Haslam made up the sub-committee panel.

I suspect it is/was a committee of three dealing with taxi appeals.

No Gentlemen, it was a conviction, so that would have been a Court, probably a Magistrates Court.

Then the LA Committee have to consider, in light of the conviction, whether the Driver remains Fit and Proper. They are not supposed to "revisit the crime" as that would be "double jeopardy" so really they should only have considered, having been convicted, was the Driver honest (or truthful if you prefer) in reporting the Conviction, they can however decide if he is remorseful.
