Yobs left taxi driver lying in middle of road after launching brutal late-night attack in town centre

A taxi driver was left with injuries including a broken eye socket after he was brutally attacked by two men in a town centre.

The victim was assaulted by Nikki Pollett and Nathan Hawkeswood while he was working in Burslem during the early hours.

The attack, which was captured on CCTV, saw the cabbie kicked and repeatedly punched before being left motionless in the middle of the road.

Now 24-year-old Pollett has been jailed for his part in the incident, while 22-year-old Hawkeswood was given a suspended sentence and ordered to pay £3,000 in compensation.

Stoke-on-Trent Crown Court heard the victim was waiting for a fare outside the Clayhanger pub when a group approached his cab.

Prosecutor Jonathan Dickinson said: "There was some trouble that caused him to get out of his vehicle, at which point the incident is captured on CCTV.

"Mr Hawkeswood appears to push the victim to the ground and then kick him. Mr Pollett appears to kick the injured party and repeatedly punches him when he is on the floor."

Pollett and Hawkeswood left the victim lying in the road following the attack, which happened at around 2am on November 26 last year. They were arrested a short time later.

Mr Dickinson said: "The injured party describes losing some level of consciousness during the course of the incident.

"He had fractures to his right eye socket, his nose and his left cheek bone, along with two broken teeth.

"He also describes red marking to his forehead, seemingly representing a footprint."

In a victim statement, the taxi driver said his wife had a baby shortly before the attack and he had been left unable to work or help her with the child.

Both Pollett and Hawkesworth pleaded guilty to assault occasioning actual bodily harm.

The court heard Hawkeswood, of Linwood Way, Tunstall, had no previous convictions and a full-time job. He has written a letter of apology to the victim. Jason Holt, representing him, said: "One thing that rings out loudly is his genuine regret and remorse.

"There is a kick on a man who is already on his knees, but Mr Hawkesworth does not continue to engage. He does move away.

"He says the offence has made him question his own character. He's disgusted that he could behave in the way he did."

Pollett, of Ball Hayes Road, Chell Heath, has a previous conviction for assault and received a number of cautions and reprimands, including one for a public order offence in Hanley which happened after this offence.

Stuart Muldoon, mitigating, said: "He's someone who has had his fair share of difficulties.

"He has now stopped going out and he has stopped drinking. He wishes to apologise to the victim."

Judge Paul Glenn sentenced Pollett to 18 months in prison. Hawkeswood received a 12-month prison sentence, suspended for 18 months, with a 35-day rehabilitation activity requirement. He was ordered to complete 200 hours unpaid work and pay £3,000 compensation at the rate of £300 a month.

Judge Glenn said: "Having been put to the floor, the victim was repeatedly punched and he was kicked. He was repeatedly punched by you, Mr Pollett, long after he had ceased to become any sort of threat to anyone.

"He was unconscious, he was utterly defenceless. You left him lying on his back in the middle of the road."

Good advice, but if someone was kicking your car its very hard not to.
