A taxi driver has been allowed back on the streets of Glasgow after being caught almost three times over the drink drive limit.

James Delaney was given a taxi driver’s licence for three years despite crashing into a parked car while under the influence of alcohol in June 2015.

Licensing committee members were told that after the incident Mr Delaney was traced to a caravan in Stirling and was found to have 89mg of alcohol per 100ml of breath – exceeding the 34mg limit.

But Mr Delaney said: “I was fishing, and I had a couple of cans of beer. I caught the car on the front.

"I went into the caravan of the owner and gave them the insurance details. I went back into my caravan and was drinking whisky and an hour and a half later the police came.

“I had drunk three glasses of whisky by the time the police came.”

The committee were told that he had been disqualified from driving for 18 months.

Asked why he wanted to return to taxiing after his driving ban, Mr Delaney added: “I drove my taxi for 21 years and I never had any trouble.

“I got an 18 month ban and then the council gave me a year’s ban.

“I went from earning a good income to nothing. I went into debt.

“I’m not a drinker, I’m working all the time. I’m not making good money labouring and I’m getting too old for it. I’m up and down off roofs and it’s all young boys I’m working with.”

Mr Delaney was granted the licence but was issued a warning over his future conduct.

Was going to say that for viewers south of the border this maybe isn't as bad as it sounds, because in 2014 the drink drive limit in Scotland was reduced, so by England's standards he wouldn't be quite as far over as portrayed in the article.

But it says the limit is 34mg of alcohol in the breath. As far as I can make out the limit here is 22mg, now and was 35mg previously, as is still the case in England.

The offence took place in 2015, by which time the new limit was in place, so not quite sure what's going on.

And while per the figures stated he may have been at nearly three times the limit, in actual fact he wasn't three times *over* the limit - he was actually 1.6 times *over* the limit.

89 divide by 34 is 2.617 not 1.6

89 divide by 22 is 4.045

I suspect that although the conviction was 2015 the original offence may have been earlier :wink:

Can't disagree with your arithmetic, but point was that while he was driving at 2.6 times the stated limit, he's not 2.6 times *over* the limit [-(

If someone's driving at 90mph in a 30 zone, they're driving at three times the limit, but they're not three times *over* the limit [-(

They're 60mph *over* the limit, which is 30 [-(

The article seems to say that the offence took place in 2015 rather than the conviction [-(

Of course the above is a common excuse used by the thick, thankfully the police and the courts have experts that can back track as to what your reading would have been at the time of the incident, and if the so called load of whisky recently drank, was in fact recently drank or not.
