Taxi driver Ferham Khan jailed for raping passenger https://www.dailyecho.co.uk/news/174320 ... passenger/ Image: Daily Echo A TAXI driver has been jailed for raping a woman in his cab. Ferham Khan was working as a taxi driver in Winchester on September 30, 2017, when he picked up the woman from Broadway at around 1am. Southampton Crown Court heard how the 33-year-old victim had been enjoying a night out with her friends and, at the end of the evening, called for a taxi to take her home. The 29-year-old driver from Derby Road, Southampton, believed his passenger had fallen asleep, pulled over in an unknown location and sexually assaulted and orally raped her. The court heard the woman was so scared that she froze. When Khan thought she had passed out through having too much to drink, he called the police and complained that he had an unconscious woman in his car and that he wanted her removed. As soon as police and paramedics turned up, the woman told them of her ordeal. Khan was immediately arrested and his taxi seized for forensic examination. When questioned by officers, Khan claimed it was an accident, saying that the woman had fallen on him while he had his trousers unbuttoned. Later Khan admitted that was a lie which he had told because he was concerned his wife would find out that he’d had a sexual encounter with another woman. However, Khan went on, claiming the victim had started touching him first and even suggested sex in return for a cheaper fare. During a seven-day trial at Southampton Crown Court the jury found Khan guilty by unanimous verdict. In a statement to the court, the victim said: “On that night, I did as any young woman would. I went out with friends and I took a taxi home. What happened in the taxi destroyed me. That man shattered my world into tiny pieces. The pain and suffering I have endured because of what he did to me has left me broken. I don’t know who I am anymore. This man has stripped me of my identity. “At the moment I am simply surviving, I take each day as it comes and pray that one day I will feel like me again and be able to start living.” The judge sentenced the Wessex Cars employee to 12 years’ imprisonment. Following the sentence, Farooq Khan – who is not relation to Ferham – the director of the Winchester’s based taxi firm, said Khan had been working for the company for a month when the incident happened. Farooq Khan said the offender had passed the DBS checks and added: “We assisted the police. He was suspended straight away.” He added that he did not think the 12-year sentence was sufficient. Farooq Khan also said that there was no camera in the taxi as, according to Winchester City Council’s policy, they are not obliged to have one, unlike taxis registered with other councils such as Southampton. Police staff investigator Joanne Parr-Daniels praised the victim’s bravery. “We are so impressed with her courage. No matter how traumatic this has been for her and continues to be, she has supported this protracted and a complex investigation of rape. Without her, we would not have been able to get Khan to face justice for what he did. “I hope now this sentence means she will be able to move forward with her life." |

Driver Ferham Khan, 33, was last week jailed for sexually assaulting and orally raping a woman he had picked up on The Broadway at around 1am on September 30, 2017. Now, the Echo has learnt Khan was in fact licensed by City of Wolverhampton Council, but was working for Wessex Cars in Winchester – which is permitted under the law, but has been described as a “grave concern” by Winchester City Council. Concerns were raised last year about Wolverhampton-licensed taxis operating in Winchester. In a letter sent to Winchester civic chiefs last spring, registered Hackney taxi driver Colin Smith said: “Instead of applying to Winchester City Council as they don’t think they can pass the relatively easy knowledge test, they bypass this and get a licence very easily at Wolverhampton.” Mr Smith also raised concerns that these drivers don’t pay fees to the council, are not subject to safety spot checks and are taking work from struggling local cabbies. Responding to the news, a spokesman for City of Wolverhampton Council said: “As is the case with anyone seeking a licence with us, he underwent an enhanced DBS check at the time of his application and had no previous convictions. “As soon as we received information from Hampshire police that they were investigating him on suspicion of a serious sexual assault, we immediately took him off the road.” The spokesman added the authority would welcome the introduction of mandatory CCTV camera is all taxis. Wessex Cars director Farooq Khan – who is not related to Ferham – stressed that the DBS checks were to the same standards wherever they are carried out. He added that he did not think the 12-year sentence was sufficient, said he would no longer be renewing Wolverhampton licences, and also backed a call for CCTV cameras. Meanwhile, a spokesman for Winchester City Council said: “The leader [Cllr Caroline Horrill] wrote to Wolverhampton last April expressing considerable concern around the possible implications of their of licensing policy. “The matter continues to be of grave concern locally. We maintain this incident indicates the urgent need to tighten up licensing laws nationally to ensure people are kept safe when using taxis or private hire vehicles.” |

Good comment on the Echo's website: branstonkicks The government has been lobbied repeatedly to introduce laws regarding this loophole and has repeatedly ignored it. You have to ask yourself why would taxi drivers look around the country to find the easiest councils to license with? A driver could have his licence revoked by one council for violence and then simply go and obtain one in another district. It's ridiculous, there should be a national database. Uber are the biggest abusers of this loophole, they have cars in Southampton which are licensed all over the country, Chichester, Havant, Test Valley, Portsmouth, Fareham, Winchester ect. Technological advances can be exploited by multinational companies like Uber that seek to drive competitors off the road with a business model based on poor pay and conditions for drivers, exploitation of regulatory loopholes and predatory pricing that is made possible by huge venture capital and aggressive tax avoidance. SCC were so concerned by the amount of non Southampton licensed vehicles in Southampton that they scrapped the local knowledge test as most new applicants could not pass it, basically kicking local taxi drivers in the teeth who are proud of their knowledge which takes years to learn properly. Now the taxi trade in Southampton is swamped with inferior, unskilled drivers who instead of concentrating on the road ahead are constantly looking at their smartphone screen to navigate. It's dangerous. My advice will always be the same, use one of the local established taxi firms in Southampton, support local people and stay safe. |
