A local taxi driver was stopped by the police and his taxi seized because it had been reported stolen. The problem seems to go back a little while. A local operator bought the car from a chap and subsequently sold it to one of his drivers. Unfortunately the operator who bought it did not do a check on the vehicle before he bought it and it has turned out that the chap who sold the car had still got finance on it. It all blew up when he stopped paying the finance and the finance company reported the car as stolen. The chap who was driving it has now been left without the car and has given the operator 2 weeks to give him his money back. This could be interesting because as far as I am aware the driver has no comeback on the operator because the operator was not aware that there was any finance on the vehicle when he bought it. I can see this all ending in tears. |

this happened to me many years ago all you have to do is write a letter to the finance company stating the vehicle was bought in good faith and challenging their right to it. It isn't worth their bother fighting it sadly I doubt I have the copies any more that the FSB gave me of the relevant court cases & legislation |

In the small claims court the operator would struggle to convince a judge that he didn't owe the driver a refund. That said the fella who sold to the operator has committed a fraudulent offence. |

It transpires that the driver has not paid the full amount for the car yet. He was paying in weekly instalments. I bet there is no paperwork in place for this transaction and no credit agreement and no licence to offer credit. |
