Uber launches appeal over TfL London ban Uber has today submitted an appeal against Transport for London’s (TfL) decision to ban the ride-hailing app from operating in the capital. TfL last month stripped Uber of its licence, stating that a “pattern of failures” left passengers at risk. The transport body said the Silicon Valley firm had unlicensed operators upload photos on other people’s accounts, leading to at least 14,000 trips involving these fraudulent drivers. All these journeys were uninsured and some of the drivers were unlicensed, including one person who previously had their licence revoked by TfL. Another issue saw banned drivers make new accounts and continue to pick up passengers, further “compromising passenger safety”. TfL also found a number of Uber drivers did not have proper insurance to operate. Uber’s UK general manager Jamie Heywood branded the decision “extraordinary and wrong” and confirmed the company would appeal. “We have fundamentally changed our business over the last two years and are setting the standard on safety,” he said. “TfL found us to be a fit and proper operator just two months ago, and we continue to go above and beyond.” The appeal will kickstart a potentially lengthy legal process, during which time Uber can continue to operate in London. |

Quote: “TfL found us to be a fit and proper operator just two months ago, and we continue to go above and beyond.” That might be your interpretation, but a better one would be that TfL didn't, at that time, have enough evidence to prove you weren't fit and proper. |

Uber gets date for London license appeal Uber's legal battle for its London license will begin on July 6. The four-day hearing is appealing a Transport for London decision to revoke its license for the second time, partly citing safety issues. Last year, an appeal led to a 15-month probationary license. Uber can continue to operate in the city while the appeal is pending. |

so another year almost from the end of their temporary extension and I doubt the bookies would give odds on their losing |

The Licensed Taxi Drivers’ Association will be an interested party in the case, giving it access to documents and meaning it could make submissions, Chief Magistrate of England and Wales Emma Arbuthnot ruled. Transport for London (TfL) in November refused a renewal request from the Silicon Valley-based company to keep operating in one of its most important markets, citing safety failures. Uber says it has made a number of changes to the way it operates to enhance safety, combat discrimination and abuse and boost the rights of drivers. The firm’s roughly 45,000 drivers in London can continue to take rides until the appeals process is exhausted, which may last months or years. In London, black cab drivers who see Uber as a threat to their livelihoods have blocked streets in protest, arguing that they are being unfairly undercut by an inferior service. Uber and TfL have been engaged in a long-running battle since TfL rejected a renewal request in 2017, citing shortcomings in the firm’s approach to reporting serious criminal offences and driver background checks. Arbuthnot in 2018 then granted Uber a probationary 15-month licence, after the company made several changes to its business model. |

I am wondering if this is a clever move by uber to make them look like the good guys vs the bad guys of the LTDA. I suspect that allowing the LTDA to get involved will weaken the case against uber and bring about judgement in their favour |

Personally I think having the LTDA involved helps by not allowing TFL and Uber to do a deal on the side. |

Uber's UK boss 'optimistic' it will win back London licence Uber’s UK boss is “optimistic” that the firm will win back its licence in the capital when courts decide in September. Transport for London (TfL) banned the ride-hailing app in London at the end of last year. It said Uber had unlicensed operators upload photos on other people’s accounts, leading to at least 14,000 trips involving fraudulent drivers. All these journeys were uninsured and some of the drivers were unlicensed, including one person who previously had their licence revoked by TfL. Jamie Heywood, Uber’s general manager for the UK, Northern and Eastern Europe told City A.M.: “At the time we had informed TfL about this well in advance and it had been fixed and addressed by the time the decision was made which is why we disagreed [with the decision.]” The case, which was originally due to be held this month, will be decided in September. TfL confirmed that the hearing would now run between the 14 and 17 September. It is understood that the concerned parties agreed that the coronavirus pandemic meant that the original timetable for the appeal, which should have started on 6 July, was no longer viable. Speaking on City A.M’s podcast, Heywood said: “I am optimistic. I think we need to continue to raise the bar on safety, always, and the job is never done”. He added that the onset of the coronavirus pandemic had presented a “new realm for safety challenges”. “We are trying to make sure we’re raising the bar on safety, not just those related to our court case and licence but in new areas”. Uber now requires all drivers and riders to wear a mask as part of safety measures due to the coronavirus pandemic. Some of the technology the firm implemented to verify drivers is now being used to ensure drivers are wearing masks. Heywood was speaking as Uber’s biggest rival Kapten this morning launched its merged service with black cab app Free Now. The new entity will give passenger access to 35,000 drivers and has a user base of 1.5m people, the firm said. Since entering the UK market a year ago, Kapten has been clear in its aims to topple Uber as the country’s leading ride-hailing firm. |
