Surprised no mention of the smoking ban angle here, but of course maybe there was no proof it was a lit cigarette, and to that degree they could only prove it was a littering offence.
But this kind of thing really annoys me, not because I don't think litterers should be brought to book, but because it's just the tip of a huge iceberg that's generally ignored, and indeed no doubt there are taxi drivers throughout the country who have thrown tens of thousands of fag ends out of their windows over the years (both before and after the smoking ban)

Investigators discovered the silver Vauxhall Zafira, which was seen littering, was registered to Emanuele Campagna, of Movers Lane.
The 54-year-old was issued a legal notice requiring him to provide details of who was driving at the time.
However, he ignored the notice which is reportedly punishable by a fine of up to £1,000.
Campagna eventually pleaded guilty to refusing to provide the information at Barkingside Magistrates Court on Friday, 31 January.
He was ordered to pay £583 costs, a £32 victim surcharge and a £150 fine.
“We are committed to cleaning up our borough and making it an attractive place to work and live,” said Councillor Margaret Mullane.
“This individual thought he was above the law and could hamper our efforts to tackle grime crime by ignoring a legal notice.”
