Surprised no mention of the smoking ban angle here, but of course maybe there was no proof it was a lit cigarette, and to that degree they could only prove it was a littering offence.

But this kind of thing really annoys me, not because I don't think litterers should be brought to book, but because it's just the tip of a huge iceberg that's generally ignored, and indeed no doubt there are taxi drivers throughout the country who have thrown tens of thousands of fag ends out of their windows over the years (both before and after the smoking ban) :evil:


Barking taxi driver fined £700 after cigarette thrown out window

A Barking taxi driver has been fined £700 after a cigarette was thrown out of a car window.

Investigators discovered the silver Vauxhall Zafira, which was seen littering, was registered to Emanuele Campagna, of Movers Lane.

The 54-year-old was issued a legal notice requiring him to provide details of who was driving at the time.

However, he ignored the notice which is reportedly punishable by a fine of up to £1,000.

Campagna eventually pleaded guilty to refusing to provide the information at Barkingside Magistrates Court on Friday, 31 January.

He was ordered to pay £583 costs, a £32 victim surcharge and a £150 fine.

“We are committed to cleaning up our borough and making it an attractive place to work and live,” said Councillor Margaret Mullane.

“This individual thought he was above the law and could hamper our efforts to tackle grime crime by ignoring a legal notice.”

Looks to me like he was fined for failing to provide details, rather than littering.

It may have been lit but unless a person is identified as smoking it then there would be no prosecution.

But the fella wasn't even charged with littering, he pleaded guilty to not supplying the details of the driver of the vehicle.

Don't think there's any suggestion otherwise, but obviously the council was targeting littering here, and the fine arose because of that, although not levied in respect of the littering offence per se.

Indeed, and that demonstrates the limitations of using CCTV (presumably) to target this kind of thing.

The limitations are based on the inefficiencies of licensing/enforcement officers not of CCTV.
