RE: PUBLIC TRANSPORT
Hope you and the family are all well. At present we would consider the taxi and private hire trade to be public transport, however I anticipate that there will be guidance issued by the Government in the next week or so which hopefully will help clarify this matter.
As soon as we know me, we will be sure to circulate it to drivers.

Taxis_private hire are part of public transport within the regulations of 1995 Taxi_PH disability act. That is why all Taxis And PH are licenced as such.

Your list from DfT says Taxis, it doesn't say Private Hire.

DfT define Taxis as available for Immediate Hire and therefore Public Transport.

The clue to PRIVATE HIRE is in the name, Private, ergo not Public Transport.

I mailed my licence team nearly 3 weeks ago and got a reply a few days later saying my queries were being handed to licensing officer.

Guess what. No reply.

I spoke to the DfT directly on Friday. They said and I quote: “ While the regulations for public transport do not cover taxis and private hire vehicles (PHV) the trade is already able to implement measures to protect drivers and passengers. Taxi drivers are already able to refuse carriage to passengers where it is reasonable to do so, this might include those that are able but refuse to wear a face covering.”

Based on the rules outlined by gov last week, no you do not.

But we have another week until the 15/6 for things to change.

It's worth pointing out that there is nothing stopping us wearing face masks whilst we are working.

And, IMO, there is nothing stopping us legally refusing punters that refuse to wear them in our cars.
