Note that the CMA's deadline for an announcement (by 26 March) is just on whether or not to continue with a more in-depth investigation, so I'd imagine if that happens then it could be the summer until a final ruling is made, or even longer. Apparently there's a 24-week limit to the 'Phase 2' investigation.
Quote:
The watchdog said: 'The CMA is considering whether it is or may be the case that this transaction, if carried into effect, will result in the creation of a relevant merger situation under the merger provisions of the Enterprise Act 2002 and, if so, whether the creation of that situation may be expected to result in a substantial lessening of competition within any market or markets in the United Kingdom for goods or services.'
Note that the criterion is a 'substantial lessening of competition', which is obviously quite vague, and could encompass lots of different things.
But historically, I think likes of CMA could have had a field day with a 'substantial lessening of competition' in local markets, but I suspect they're just too small to bother with.
But because Uber has a national presence, it's a different ball game now.
Of course, it's all quite technical, and even the CMA's 'Quick Guide to Merger Assessment' is 18 pages.
Still maybe worth a read, though, even ignoring the more technical bits.
I mean, for a start, are we talking 'horizontal', 'vertical' or 'conglomerate' merger?
