So if the driver is self-employed, why have you 'identified and spoken' to him? What's it got to do with Boro Cars?

self employed or not he was in a vehicle which was identifiable as representing Boro cars so yes they do have a corporate responsibility to take some sort of action

In the video footage, the man opens his car door and drops a white scrunched up piece of rubbish onto the road. When he is asked if he is going to pick the litter up, the driver says: "I just dropped it here". He picks up the rubbish, which looks like a napkin, as well as a white takeaway box sitting alongside it. The driver later goes on to say "I didn't realise" and "sorry about that" as he shuts his car door. The incident happened outside The Ironstone Miner in Guisborough at around 5pm on Thursday. The onlooker said the driver appeared to be waiting on a fare from the pub. They said: "It’s disgusting some people have no respect for our area. "Thinking it’s acceptable to dump his litter in middle of the street. "Would he do the same outside someone’s house or layby while waiting for a fare. "It’s just making more work for council staff, cleaning up this kind of mess, and people wonder why we have to pay more council tax." A spokesperson for Boro Cars said: "We have identified and spoken to the self-employed driver. "He will also be reported to his regulator, so that they can take the appropriate action in relation to this unacceptable conduct."

Interesting also the phrase 'reported to his regulator', which is again effectively passing the buck to the council. Also not sure if this is all for PR purposes, or if it's maybe linked to the self-employment debate. Perhaps a bit of both

Just thinking there, too, has vehicle signage etc ever been raised in the self-employment debate? Not that the Boro Cars logo on the video is the most prominet you're likely to see, but to my mind logos and certainly the more prominent ones are surely indicative of control and thus point towards 'worker' status? And, by the same token, because I don't think the likes of Boro would allow another operator's logo on one of their cars, surely such 'exclusivity' is symptomatic of control and thus 'worker' status Maybe a bit like driver uniforms, which are certainly mentioned in the debates and legal arguments.

But to that extent and that the driver was in a vehicle 'identifiable as representing Boro cars' (as you put it), then I think that kind of thing is relevant to whether the driver can be considered self-employed or not. If a business has a 'corporate responsibility' with regard to the actions of an individual then that undermines any claim that the individual is self-employed
