On the one hand, this looks a bit harsh - nothing to say there was any police involvement or any criminal behaviour, and essentially the driver was revoked based on a single complaint from a member of the public.

On the other hand, it does say the whole incident was caught on the complainant's dashcam, and that it was viewed by councillors, therefore...

But there's effectively zero about the substance of what the complaint was all about, other than that it was a road rage incident. Instead, there's lots of waffly stuff about protecting the public etc.

So councillors could be perfectly correct here, but on the basis of the article it hardly resassures cynics like me that they acted fairly and proportionately :?

A taxi driver in Gainsborough has had his taxi licence revoked following a complaint received from a member of the public.

West Lindsey District Council’s Regulatory sub-committee made the decision to revoke his taxi licence following a hearing on Thursday 21 July 2022.

After hearing all the evidence, the committee determined that the driver, due to his behaviour, could no longer be considered a fit and proper person to hold one of West Lindsey District Council’s taxi licences.

Kim Enderby, Senior Licensing Officer for West Lindsey District Council dealt with the case. He said: “We were contacted by a member of public who reported being in a ‘road rage’ type incident involving a vehicle displaying a West Lindsey Taxi Licence plate.

“A dashcam on the car driven by the witness had captured the whole incident. We immediately began an investigation, interviewed the taxi driver and assessed all available evidence. We believed that the way in which he had behaved fell far short of what is expected by West Lindsey District Council.

“This decision by the Regulatory Sub -Committee sends a clear message and shows the public that poor behaviour by anyone licensed by West Lindsey District Council will not be accepted.”

Cllr Owen Bierley Leader of West Lindsey District Council said: “Revoking a licence is never an easy decision as we are fully aware of the impact this has on any individual.

“We had to decide based on the information before us, would we allow a person for whom we care, regardless of their condition, to travel alone in a vehicle driven by this person at any time of day or night? Was this driver a fit and proper person to continue to hold a licence issued by the council.

“After watching and hearing all the evidence we no longer had the confidence that this driver should be allowed to continue to operate on one of our licences.

“The Sub-Committee had concerns as to his conduct and his ability to adhere to the highest standard of conduct that the council holds licensed drivers to, noting that the code of conduct is very explicit in that regard.

“The paramount reason of hackney carriage and private hire licensing is to protect the public above all else. As a consequence, it would be inappropriate to allow a driver to retain a licence, when it was felt they may pose a risk to public safety. We will not fail to hold to account anyone who falls below the high standards we expect of anyone operating on a licence issued by West Lindsey District Council.”

There is a 21-day appeal period, after which if no appeal is lodged the licence is revoked. Due to legislation we are unable to disclose the name of the taxi driver involved.

A bit harsh i would have thought a warning about subsequent behaviour might have been the correct decision

It will be interesting to see if he appeals and what the mags say.

As SW alludes to we really don't know the full story.

If it was just a couple of Fs then I think it was harsh, however if there were threats of violence, and maybe children present, then I can see why the license was revoked.

Hopefully, the fella will appeal and we might get a bit more info via the court hearing.

Well he did appeal.

But this has little more information about the substance of what happened than the article at the top of the thread :-o

Lots of description of the procedural stuff and council 'safety is paramount'/'comms'-style blather, but nothing more about what actually happened.

Gainsborough taxi driver loses appeal against revoked licence

A taxi driver has lost his appeal against a decision by West Lindsey District Council to revoke his licence.

John Flynn, 58, of Gainsborough, appealed the revocation of his taxi licence by West Lindsey District Council’s Licensing sub-committee to Lincoln Magistrates Court. The appeal was dismissed at a hearing held on Friday 9 June 2023.

After hearing all the evidence, the District Judge upheld the original decision of the Licensing sub-committee, meaning John Flynn can no longer operate a taxi.

Speaking after the hearing, West Lindsey District Cllr, Jim Snee, Chair of the Licensing sub-committee, said:

“The decision to revoke a licence is never an easy one to make. The paramount reason of hackney carriage and private hire licensing is to protect the public above all else.

“Obtaining a licence from West Lindsey District Council is not an automatic right. Any individual must meet and continue to maintain the exacting standards that we expect of anyone operating on one of our licences.

“The decision by the court to dismiss Mr Flynn’s appeal and uphold the decision of West Lindsey District Council’s Licensing sub-committee, sends a clear message and shows the public that poor behaviour by anyone licensed by West Lindsey District Council will not be accepted.”

West Lindsey Council revoked Mr Flynn’s taxi licence at the original hearing on 21 July 2022. Kim Enderby, Senior Licensing Officer for West Lindsey Council, said:

“We were contacted by a member of public who reported being in a ‘road rage’ type incident involving a vehicle displaying a West Lindsey Taxi Licence plate driven by John Flynn.

“A dashcam on the car driven by the witness had captured the whole incident. We immediately began an investigation, interviewed Mr Flynn, and assessed all available evidence.

“This evidence was placed before the Licensing sub- committee, who revoked the taxi licence. Mr Flynn decided to appeal the decision but lost his appeal at Lincoln Magistrates Court last week.”

In fact, apart from the fact that the driver appealed to the magistrates' and lost, much of the above is just a rehash of the original revocation press release :-o

I mean, isn't it funny that two different councillors have used precisely the same clunky English to make exactly the same point almost one year apart :roll:

A few days ago, West Lindsey District Cllr, Jim Snee, Chair of the Licensing sub-committee, wrote:

Almost one year ago, Cllr Owen Bierley Leader of West Lindsey District Council, wrote:
“The paramount reason of hackney carriage and private hire licensing is to protect the public above all else."

But, of course, the other big difference is that the driver now has his name splattered all over the press.

It's a pity passengers aren't held to the same exacting standards [-(

it makes you wonder how selective the evidence was because road rage doesn't normally happen out of the blue ! I suspect the video evidence might have had the original cause removed so as not to incriminate the complainant.

Be surprised either of those councillors typed or wrote a single syllable.
