Looks like he got a good enough deal as well - £30 at 1am for a 13 mile run (according to Google).


Drinking ban for man who racially abused and assaulted a taxi driver

A 49 YEAR old man racially abused and assaulted a taxi driver after drinking 15 pints of beer, heard Skipton Magistrates Court.

Thomas Stoney repeatedly used racist language towards Saeed Pervez, assaulted him, and damaged his vehicle after refusing to pay an agreed fare of £30.

Stoney grabbed Mr Pervez by his jacket, tearing it, caused him to fall to the ground, resulting in a cut knee, and breaking the screen on his mobile phone. He also tore off the vehicle's illuminated sign while it was parked in a layby in Cononley and threw it though the vehicle's rear windscreen.

He was told by magistrates on Friday he would be banned from drinking for 121 days as part of his sentence and pay the taxi driver substantial compensation.

The court heard Mr Pervez picked Stoney up from Sheep Street, Skipton at 1am on June 19.

Stoney told Mr Pervez he wanted to go to Crossflatts and a fare of £30 was agreed.

The journey started fine, but Stoney started to get a bit 'agitated' and Mr Pervez, an experienced taxi driver of 30 years, thought he might have a problem, the court heard.

"He said (the fare) was too high, would not pay it and continued to haggle," said Mr Pervez in a statement. "He was trying to intimidate me and was using swear words."

Prosecuting, Martin Butterworth said Mr Pervez pulled into a layby on the A629 in Cononley, told Stoney to give him £10 for the journey so far and to get out.

Both men got out of the vehicle, Stoney grabbed hold of the other man's jacket, there was a struggle and Mr Pervez fell down, cutting his knee on the road surface and breaking the screen of his mobile phone.

Stoney then took hold of the illuminated sign on top of the vehicle, wrenched it off and threw it through the rear window, smashing the glass.

Mr Pervez got on his radio calling taxi colleagues and police. He was very shaken by what had happened and stated despite having customers previously argue a fare, he had never experienced such behaviour and feared what Stoney would do.

When interviewed by police, Stoney remembered getting into the taxi but claimed the driver had pulled him out of the vehicle and that he had 'seen red'.

Andrew Watson, from the probation service, in a pre-sentence report, said Stoney, of previous good character, had been with friends in Skipton from about 3pm and had drunk about 15 pints of beer.

Mr Watson said Stoney denied having entrenched racist views and that he had ethnic minority friends. A self employed joiner, he drank three times a week and occasionally to excess at weekends. He was also an occasional user of cocaine.

Mitigating, Siobhan White, said Stoney was genuinely remorseful for his 'shocking' actions and 'rightly so'.

Stoney, of Newlands Drive, Bingley, admitted racially aggravated common assault, criminal damage and possession of cocaine.

He was given a 12 month community order with 15 rehabilitation activity requirement days. He was also given a 121 day alcohol abstention monitoring programme, involving him being fitted with monitoring equipment. He will also have to pay £900 compensation to Mr Pervez and pay costs of £85 and a surcharge of £114.

Certainly quite a cocktail (excuse pun) of punishments, fines and costs. Don't know whether all that's reasonable for what was quite a kick off, and while in some ways it looks stringent enough on paper, what all that means in reality is anyone's guess :roll:

Sounds about right.

Basically you have the assault/crim-damage and possession matters. When you reach a decision based on the sentencing guidelines for them you have to bump it up even further to take account of the racial aspect.

The alcohol monitors are little sensors strapped to the leg (I think) that test 24/7 if you have had any alcohol.

Not clear why this has appeared two months after the conviction, but part of it reads like Craven Council's PR offensive in favour of mandatory CCTV, which of course was covered in other threads and which was an ongoing sore point for many opponents in the local trade.

But, of course, two months isn't very long in council-land, and maybe with holidays etc it's taken them two months to issue this :roll:

Craven District Council is reminding passengers that their conduct while travelling in taxis is being recorded and will be used as evidence against them if they commit crimes.

The warning follows a recent incident where CCTV footage was instrumental in helping to secure a conviction for assault.

Earlier this year, Mr Saeed Pervez (62), a taxi driver in Craven for 32 years, was the victim of an early morning assault. The defendant, Thomas Stoney, of Newlands Drive, Bingley, appeared before Skipton Magistrates Court and admitted racially aggravated common assault, criminal damage and possession of cocaine. He was given a 12-month community order with 15 rehabilitation activity requirement days. He was also given a 121-day alcohol abstention monitoring programme, involving him being fitted monitoring equipment. He was also ordered to pay £900 compensation to Mr Pervez and pay costs of £85 and a surcharge of £114.

Speaking after the case, Mr Pervez said: “The vast majority of our fares are honest, decent people, but there tends to be a small minority who spoil it. CCTV was installed in my taxi in February this year and at the time I must admit it was a huge financial expense, but I am now relieved I did because footage helped police not only charge the defendant, but I received costs for the damage caused. It’s an excellent initiative as it makes life safer for both drivers and passengers. Plus, the behaviour of some of the passengers is a lot better if you warn them that ‘you’re on camera’.”

Craven became the first area in North Yorkshire to mandate CCTV cameras in taxis on 1st January 2022.

Chair of the Licensing Committee for Craven District Council, Cllr Chris Moorby said: “Everyone has the right to go about their day without the fear or intimidation and we do not tolerate any form of physical or verbal abuse towards drivers or customers. Video footage, like CCTV, continues to provide vital evidence to the police and serves as a powerful deterrent to those who intend on abusing taxi drivers”

Cllr Moorby’s views were echoed by the Council’s Licensing Manager, Mr Tim Chadwick, who said: “Craven District Council recognises the need to be proactive in reducing crime, improving health and safety and drivers' well-being. The safety of the public and of drivers is our primary concern. Violence and aggression towards taxi drivers is never acceptable and will not be tolerated.”

A quick glance through the original press article about the conviction doesn't even hint at any kind of evidence of the CCTV kind, which seems a bit strange since that seems to be a major 'selling point' in the council's new press release :?

Who would have thought that a video record of an offence being committed would have been instrumental in gaining a conviction?
