| Post subject: | driver up before the sub committee for rape |
I have been told that a driver here has had his license immediately revoked after being accused of raping 2 women. The sub committee meet next week to ratify the decision. The driver is currently on police bail and is not allowed into our town as part of his bail conditions. |

From what I can see the driver has not even been licensed for a year. I wonder where this leaves our licensing team who decided that he was a "fit and proper person". I wonder if the driver had a DBS certificate or a letter of good conduct from his home country? |

If they were prior to him being licensed, then questions should be asked of the licensing team. All they have to go on is the DBS or the letter of good conduct. Even me, a skeptic of the highest order, doesn't for a second believe any LO would license someone who is alleged to have committed sexual assaults. |

The 2 incidents are very recent, the last couple of months. |

They can Suspend, Revoke or (if his badge has expired) Refuse to Renew. They can do this as an adjunct to his Police Bail. What they choose to do will then stay in place I believe. It would be better if he was charged and the Magistrates Remanded him in custody or, granted Conditional Bail, with a condition being "Thou Shalt not Drive a Taxi or PH Vehicle. |

I'm unsure about the legality of the committee getting involved in changing a revocation. Pretty sure once revoked only a court can change that. |

Quote: If I remember correctly if someone has their license suspended the committee can't then revoke that license. Once someone has been suspended no one can revoke. Be that officers, committees, or courts. |

If they were merely being advised of an action by an officer then fair enough, but it appears they are being asked to decide on that matter. And if they are then surely they must have the powers to not accept the officer's decision. In short, this is a pointless issue for them to decide on. |

If he isn't charged or the allegations prove to be false then there is a case to be answered by the council. Nothing mentioned on the internet in news sites or anywhere so we'll see. I would think though that the chap arrested would almost certainly have switched to waiting tables or working in a takeaway they usually do. |
