Robert Scott, 29, and sibling Christopher, 27, appeared from custody at Hamilton Sheriff Court.

A taxi driver was attacked and subjected to racist abuse after two brothers refused to pay him up front.
Robert Scott, 29, and sibling Christopher, 27, appeared from custody at Hamilton Sheriff Court.

Robert admitted assaulting the male driver and acting in a threatening or abusive manner in St Andrew's Court, Blantyre, on September 13.

Christopher was cleared of taking part in the assault but admitted threatening police officers and spitting blood.

The court heard an argument started after the taxi arrived to pick up the men shortly after midnight.

The brothers were asked to get out as they refused to pay ahead of their trip. The cabbie pressed an alarm to get help but Robert Scott grabbed his phone and threw it into the footwell.

He also used a deeply offensive racist term before dragging the driver out of the cab, pulling him to the ground and punching him.

Police officers arrived and viewed the taxi's dashcam footage. They could hear Scott yell at the driver 'You're going to die tonight'.

Christopher Scott hurled abuse and threats at officers after his arrest, spitting blood and warning them that he had Hepatitis C, though tests showed he didn't have the virus.

Stephen McQuillan, Robert Scott's lawyer, said his client had been doing well on his release from a prison sentence and had secured a job, but on the night of this incident he had been drinking heavily.

Stephen MacBride, defending Christopher Scott, said he has mental health issues and "was not in a good place" at the time of the offences.

He was spitting blood after sustaining a cut earlier.

Sheriff Linda Nicolson jailed Robert Scott for 18 months and Christopher for 13 months.

Both men were set to be released immediately as the sentences were backdated and they had been in custody since their arrest in September.

So presumably their sentence discount has been backdated as well, because they've only been in custody for 11 months, and both sentenced to longer periods :-s

It has nothing to do with any guilty plea discount, it's down to them being released on license halfway through their sentence.

That's kind of what I meant, Sussex, but just got the terminology wrong :oops:

But parole - or similar - was what I meant, so it's a kind of post-sentence discount for good behaviour, rather than pre-sentence discount for a plea bargain, or whatever.

But since it's after the sentencing event, sort of thing, maybe refund is a better term than discount :lol:
