Nothing much to see here, and Tewkesbury seem to do quite a lot of this kind of stuff (by which I mean prosecutions and press releases... :-o )

But, as usual for this authority, you're half expecting them to say that they had to involve Interpol and the FBI in the investigation and prosecution :lol:


Private hire driver prosecuted for illegally plying for hire

Tewkesbury Borough Council has successfully prosecuted a private hire driver for illegally plying for hire.

On Monday, 9 December 2024, Omer Shahzad, 36, of Windyridge Road, Cheltenham, pleaded guilty to plying for hire on 13 March 2024. Mr Shahzad, a licensed private hire driver, was seen picking up a fare in Cheltenham that was not pre-booked.

On 30 September at Cheltenham Magistrates’ Court, Mr Shahzad pleaded not guilty to the offence, but at a hearing changed his plea to guilty.

He was fined £1,000 with a victim surcharge of £400, and costs of £1,000 were awarded to the council.

The prosecution was brought by Tewkesbury Borough Council’s Licensing team, with assistance from the council’s Counter Fraud and Enforcement Unit and One Legal, a legal service shared by Cheltenham Borough Council, Gloucester City Council, Stroud District Council and Tewkesbury Borough Council. The prosecution followed a complaint from a member of the public.

Tewkesbury Borough Council’s Lead Member for Environmental Services, Councillor Sarah Hands, said “Tewkesbury Borough Council is committed to ensuring the safety and legality of private hire services in our community. This successful prosecution sends a clear message that we will not tolerate illegal activity and will take decisive action to protect the public.

“I commend our Licensing team, the Counter Fraud and Enforcement Unit, and One Legal for their diligent work in bringing this case to a successful conclusion.”

Another case of the council 'working closely' with partner agencies, or whatever :lol:

But it's a bit different from the normal council press releases about prosecutions for plying for hire, guide dog refusals and unplated/unbadged cars and drivers.

But I doubt many would really notice the taxi angle to this, except that Gloucester Live has headlined its rehash:

He did not tell the council or DWP about his employment



...but, for what it's worth, this is the official council press release. It says the CPS prosecuted on behalf of the DWP for the benefits fraud, but does that mean the council did the prosecution for the council tax stuff? Not sure about the nuts and bolts of all this... :-k

A Tewkesbury Borough resident has been prosecuted for fraudulently claiming council tax reduction, housing benefit and pension credit.

Larry Gough, of Lambert Terrace, Shurdington fraudulently claimed over £2,200 in council tax reduction and £8,285.61 housing benefit from Tewkesbury Borough Council, and £11,726.33 in pension credit from the Department for Work and Pensions (DWP).

At a hearing at Cheltenham Magistrates Court on 3 December 2024, Mr Gough pleaded guilty to one charge under the Council Tax Reduction Scheme (Detection of Fraud and Enforcement) (England) Regulations 2013 of making a false representation to obtain council tax reduction.

He failed to notify the council or the DWP that he was in employment as both a taxi driver and a delivery driver and his failure to declare this has resulted in an incorrect reduction of his council tax liability totalling £2,212.37 for the period 14 September 2020 – 23 August 2023.

Mr Gough also pleaded guilty to offences of dishonestly making a false representation in order to obtain a benefit contrary to s.111A(1)(a) Social Security Administration Act 1992 in respect of claims for pension credit and housing benefit. He fraudulently claimed pension credit totalling £11,726.33 and housing benefit totalling £8,285.61.

Mr Gough was sentenced on 8 January 2025 at Gloucester Crown Court to a 12-month community order to undertake 80 hours unpaid work for all offences. In addition, he was ordered to pay £95 surcharge.

The investigation was carried out by officers from the Counter Fraud and Enforcement Unit of Tewkesbury Borough Council, working with colleagues from the DWP, after the council received reports regarding Mr Gough’s circumstances. The prosecution was brought by the Crown Prosecution Service on behalf of the DWP in connection with claims for pension credit and housing benefit.

Tewkesbury Borough Council’s lead member for Finance and Asset Management, Councillor Stewart Dove, said “Tewkesbury Borough Council is committed to ensuring that public funds are used appropriately and that those who attempt to defraud the system are held accountable.

“This successful prosecution demonstrates our dedication to protecting the integrity of our welfare system and supporting those who genuinely need assistance.

“We encourage residents to report any suspicions of fraud to help us maintain fairness and justice in our community.”

That'll teach him :-o

And presumably he has to repay the overpaid benefits etc? Can't see any specific mention above, but maybe that's just assumed... :?
