Well if yesterday's council press release (can't even remember where it was now :-s ) was thin on concrete information, this one is even worse :-o

But unusual in that it went to the crown court, and he lost again. (Or at least I think that's what happened, but think I misconstrued the last one involving a crown court appeal from the magistrates' :oops: 8-[ )

We're not even told the costs figure. But I suspect the council maybe displaying a bit of triumphalism and relief here as opposed to conveying the nitty gritty of what it was actually all about...

(Not sure if either court here can officially be designated an 'appeal court' as per my thread title, but they certainly are appeal courts with regard to trade revocations and the like.)


Taxi driver loses licence

A taxi driver has lost his appeal against the Council’s decision to revoke his taxi/private hire licence.

The driver had his licence revoked with immediate effect in May 2023 when the Licensing team received information that gave rise to serious concerns about public safety.

Following an earlier unsuccessful appeal at Medway Magistrates Court in 2024 the driver made a further appeal, and at a hearing in Maidstone Crown Court on 9 April 2025 the judge upheld the decision to revoke the licence and awarded costs to the Council.

Gary Stevenson, Head of Housing, Health & Environment, Tunbridge Wells Borough Council said: ‘People who use taxis and private hire vehicles licensed by Tunbridge Wells Borough Council should feel safe. This was a lengthy case but it was important that the Council defended the decision to revoke the licence. We will always put public safety first.’

That's the way it goes.

Councils revoke, first appeal to the Mags Court in front of a District Judge (Mags Court) or a bench of three JPs, second appeal to the Crown Court in front of a Judge and two JPs.

Yes, that was the guy who was on remand, but never convicted of anything, which I questioned at the time? But maybe that's why there's a distinct lack of detail in the council's press release...maybe a tad awkward in terms of the optics.

And that's also the thread where I had to school Chris about something-or-other.

Or maybe Chris schooled me - I've got a very selective memory when it comes to stuff like that :lol: 8-[

And thanks for the insight, Sussex - but I was just about to say all that :---)

By the way, I didn't mean it was unusual that he lost, but unusual that he'd appealed it twice...

So maybe I'd have been better to use a full stop rather than a comma :-o
