This is in on all the Scottish news sites, but this is the official prosecutor's press release, since the articles just seem to be a rework of this. So he took her to his home, where he raped her, then drove her back to her own home. So another one where there's no evidence of coercion, but the rape conviction is because the victim was intoxicated and thus incapable of consenting. And, as I've said before, in the non-taxi context this kind of sexual encounter must be quite commonplace - so I wonder how [edited by admin] blokes are meant to decide when the victim is too intoxicated to be incapable of giving consent? Must be a thin dividing line at times... But not clear which code this driver was working under, or where he was badged. But give the impression that the job was a pre-booking... And although it says 'Glasgow taxi driver' in the headline etc, he lives in Drumchapel, which is in the city council area, but the pick up was in Clydebank, which is in the West Dunbartonshire Council area. The High Court in Glasgow heard how the 39‑year‑old had collected the victim and her friends from a pub in Clydebank in the early hours of 30 September 2023. After dropping off all passengers apart from the victim, Tosh marked the fare as completed and logged out of the taxi’s GPS tracking system. He then drove the 23‑year‑old woman in the opposite direction to where he was supposed to take her and brought her to his home, where he raped her. Two hours later, he logged back in to the tracking system while driving away from the direction of the victim’s home, where he had dropped her off. He was later identified after a friend of the victim showed her a picture of Tosh from social media. As well as the GPS evidence, the prosecution presented further evidence that proved the driver’s criminal actions. This included DNA results, text messages and witness accounts. On 7 April 2026, at the same court, Tosh was jailed for seven years, and his name was added to the sex offenders register indefinitely. A 10-year non‑harassment order, banning him from contacting or attempting to contact the victim, was also granted. Faye Cook, Procurator Fiscal for High Court Sexual Offences, said: “This was a despicable betrayal of trust by a man who was responsible for getting a woman home safely after a night out. “Thomas Tosh deliberately concealed his location as he drove the victim to his home, where he raped her while it was clear she was unable to consent. “I want to recognise the courage shown by this young woman throughout the prosecution process. Her strength has helped bring a predatory offender to justice. “Scotland’s prosecutors will continue to use every tool available to pursue those who abuse women and girls, and to protect the public from harm.” |

Must be a thin dividing line at times... Any taxi/PH driver who behaves that way with a punter is an idiot asking for trouble. As for the non-taxi/PH driver, I think if you are sober you know when a lady is too pi**ed to consent, i.e. unable to walk properly, unable to undress, unable to engage in anything in a normal manner. |

Indeed, Sussex, but back to my point about pished-up men and women out 'on the pull'. Of course, it must be pretty obvious in some scenarios (like the St Andrews sexual assault in the licensing section thread), but it otherwise must be difficult to delineate the line between too intoxicated to consent and capable of consenting. |

It's all down to the evidence. I suspect the vast majority of instances similar to what we are discussing never make it to court. So if both parties are indeed out of it, the pros and cons of consent are virtually impossible to work out. The St A situation you posted elsewhere is (based on the facts in the article) quite an easy one to decide on. She was out of it, and he wasn't. And he said he did it. |
