it was in the courts a couple of weeks ago.

11:50 - 30 August 2007

A czech taxi-driver has denied causing the deaths of two Plymouth bikers on Dartmoor.Jakub Navratil, aged 28, yesterday pleaded not guilty to a single charge of causing death by dangerous driving at Plymouth Crown Court.

Pale-faced, clean-shaven Navratil, of Commercial Road, Coxside, answered "Yes" to confirm his name, but pleaded not guilty through an interpreter.

Peter and Michelle Luscombe died on May 20 this year when their motorcycle was involved in an accident on the B3213 Yelverton to Princetown Road.

Navratil is accused of causing the accident in his Y-registered Vauxhall Vectra.

Judge Francis Gilbert QC said the trial should be held as soon as possible.

But there were gasps from the packed public gallery when the case was adjourned for trial until January 21, 2008.

Judge Gilbert said that if the date could be brought forward it would be.

No appeal for bail was made and Navratil was remanded back into custody.

makes you think doesn't it the local driver who killed a motorcyclist on the A1 last year whilst driving at high speed has been allowed to carry on working normally   and will only be taken off the road if he is convicted although such cases usually take an avrage of 18 to 24 months to go to court round here

That's all changed with the new Road Safety Act.

Now you are deemed to be guilty until proved innocent.

FAMILY'S FURY AS DRIVER GOES FREE

CARL EVE HERALD REPORTER

07:30 - 25 January 2008

The family of two motorcyclists killed in an accident with a taxi driver say they feel "total shock" and "very angry" after he was cleared by a jury of death by dangerous driving.

The jury at the trial of Jakub Navratil reached a not guilty verdict on the charge, but admitted to Judge Francis Gilbert, QC they would be unable to reach a decision on any alternative charge of careless driving, even if offered more time to deliberate.

Peter Luscombe, 53, and his wife Michele, 51, were killed when their Yamaha Vmax collided head on with Mr Navratil's Vauxhall Vectra on the B3212 between Yelverton and Princetown on May 20 last year.

During the trial Mr Navratil admitted he had initially told police in a statement: "It's my fault - I must've been blind for a second to not see the motorcycle."

Speaking outside Plymouth Crown Court following the verdict, Michelle Luscombe, daughter of Peter, spoke of the whole family's anger and loss.

Alongside distraught family members and friends, she said: "Myself and our families have been left in total shock and feel very angry.

"We feel numb with shock and feel very let down by our legal system.

"Our parents went out for a Sunday drive and had their lives taken away.

"We will never get over the pain. He has ruined our lives.

"Instead of celebrating their grandson's third birthday today - and the forthcoming birth of another - they are gone and we are all here with nothing."

Mr Navratil was driving along a stretch of road known as the Devil's Elbow on Dartmoor when he claimed he attempted to overtake a "small green car" on May 20 last year.

None of the witnesses for the prosecution recall seeing such a vehicle.

The 28-year-old, who had been brought over from the Czech Republic by city company Taxifast, which had trained him in early 2007 both in Prague and Plymouth, did not see the Luscombe's motorbike concealed in a dip in the road.

According to the Vectra's frozen speedometer, Mr Navratil was travelling on the 40mph road at somewhere between 55mph and 60mph at the moment of impact.

Mr Luscombe and his wife, riding as a pillion passenger, were flung from their bike and despite the efforts of numerous members of the public - including two off-duty emergency medical technicians - they died at the scene.

Michelle thanked the help offered to them by Family Liaison Officers MPc Dave Carne and MPc Tracy Sharam, from Newton Abbot road traffic unit.

In addition, she said she and her family wished to thank "the members of the public who tried to help at the scene".

Judge Gilbert said: "Given that the defendant has already been in custody for many months that is a far greater punishment than he would get for careless driving.

"It would therefore be wrong - and unnecessary - to proceed any further."

Mr Navratil's defence team said their client would now be returning to his home country.

As he left the court via the front entrance, with a bag full of clothes slung over his shoulder, Mr Navratil declined to make any comment.

I'm sure this tragedy would not have occurred if the drive had been required to take a DSA test......the bastward would never have got his badge :x

Well I'm not so sure Mr hopper, since it's self-evident that many people can pass a driving test then ignore what they've learnt in practice - I'm sure that most of us do that to a greater or lesser extent.

However, a compulsory DSA test would probably weed out some of the more dangerous and feckless drivers - thus a step forward but not a panacea.
