Tribunal upholds sacking over 'taxi' ambulance

A WOMAN who was sacked for sending an ambulance to pick up her drunken boss has failed in her latest unfair dismissal claim.


The Employment Appeals Tribunal has dismissed an appeal by Margaret Gokce, 52, against a Glasgow employment tribunal decision rejecting her unfair dismissal claim, and bid for GBP30,000 compensation.

The appeals tribunal found it was not unreasonable for the Scottish Ambulance Service to see Mrs Gokce's actions as a sacking offence.

She had sent an ambulance to pick up her then boss from Cleopatra's nightclub in Glasgow's West End at 1am on August 28, 2003, so delaying response to a 999 call by up to three minutes.

In its findings, the tribunal said: "The employers were faced with deliberate misconduct where Mrs Gokce was helping a friend, but thereby putting at risk the operation of the emergency service.

We have no doubt, as the tribunal found, that a reasonable employer could indeed say this was too serious to let pass."

Mrs Gokce, of Crichton Place, Cowlairs, took legal action when she was sacked in October 2003 after 16 years' service, along with her former manager Denise MacDonald, for whom the ambulance was called, and a colleague, Mrs Connor, who called for the ambulance.

The two ambulance crew members who attended were given final written warnings.
