Taxi Driver Online

There seems to be a virus that is being transmitted on the Local Government licensing Network probably by NALEO advising all councils that it is perfectly legal for private hire vehicles to form Taxi ranks on the streat and have persons acting as agents taking bookings on their behalf.

Manchester is the latest local authority to introduce private hire taxi ranks and for those familiar with the track record of the local representatives will know from the rank Marshal fiasco what to expect. We've already had the Manchester TOA say on record that they will abide by the councils wishes, regardless of what the the law might say and no doubt every other organisation in Manchester will fall in line. Talk about being a hostage to fortune?

We have one in Croydon.

It's policed by a private security firm, needless to say every tout under the sun is now taking full advantage of this, and the 'marshalls' are not particularly interested, as long as there is no trouble.

The 'do what we want' mentality spreads.

If this is not nipped in the bud, there could be big problems in the ranks,
but if it spreads like wildfire and councils all over the UK accept it, what is the point in paying for a hac licence when a PH will do, to do the same job

No limits on PH, no DDA and very few areas with knowledge tests for PH. It really could become a "free for all"

I think most people will it see it that way. If councils think it is legal in one part of a town then it must be legal in every other part of a town. What's the point of of paying 30 grand for a purpose built WAV when you can get something that does the same job for a lot less.

There are laws on touting that have reached even, I'm led to believe, Manchester.

I can't see a court, when evidence is put before them showing a line of PHs taking bookings from a person in the street, that wont convict for touting.

Now if they are marshalling folks that have already booked via an office, then that might be different. But experience from driving a PH for many many years, says it don't always happen like it legally should.

Or so I'm told.

The problem with councils who condone the activity of persons standing in a street taking bookings for private hire vehicles or any other type of vehicle for that matter regardless of whether they are ranked up close by is the fact that such activity is not within a councils jurisdiction. A council is given the task by law of licensing vehicles and it has no powers to allow any vehicle other than a hackney carriage to rank up or sit in a rank awaiting a job booked by someone off the street. I think that is the point that is sadly being missed by all these councils who "think they have the legal power to sanction such activity".

If a person, in a public place, solicits persons to hire vehicles to carry them as passengers, he is guilty of an offence2.
