Taxi Driver Escapes Jail after Attacking Passenger A taxi driver who attacked a passenger with a wheel brace after his driving was criticised escaped jail today. Leicester Crown Court heard how 31-year-old Saad Miah bashed Andrew Gilmore over the head repeatedly after the customer accused him of speeding and jumping a red light. The attack was so serious it left the victim in hospital needing stitches to a head wound. But Miah, of Sparkenhoe Street, Leicester, was spared a prison sentence today after the court was told it would lose the father-of-two his job. Instead, he was ordered to pay Mr Gilmore £1,200 in compensation and serve the maximum 200 hours of community service. Miah had collected Mr Gilmore from outside a bar in East Bond Street, Leicester, shortly after midnight on Sunday, February 29. Before they got to their destination a heated row broke out between the driver and customer. It was sparked, said prosecutor Jeremy Janes, after the defendant allegedly broke the 40mph speed limit and jumped a red light claims the defendant denies. Mr Janes said: “Mr Gilmore remonstrated with the driver and asked for his badge number. It was at this stage that the defendant got out of the car with his wheel brace and struck the complainant.” The assault left the Leicester bus driver with 2cm-long wounds to the back of his head, forehead and ear, said Mr Janes. Mitigating, Carl Gaskell said Miah had admitted the charge of wounding with intent but had only panicked after “severe provocation” from Mr Gilmore. “He felt under threat of attack from Mr Gilmore because of his verbal abuse and swearing,” he added. “He did feel under severe provocation. He had never been in that situation before. “He suggests Mr Gilmore had too much drink than was good for him. Mr Gilmore accepts that he did shout and swear at the defendant.” Mr Gaskell said Miah, the main earner for his family, could lose his job with Swift Taxis if sent to prison. Recorder Frances Judd said she would not send Miah to prison because the case had been “exceptional”. She said: “It’s undoubtedly a very serious offence. In almost every case of this nature you would be expected to be sent to prison. However, it has been urged upon me not to do that in your case. “In the very beginning this is a very unusual case, but I pause to say it’s no excuse that you have had a verbal altercation to assault him afterwards. But it does provide mitigation. “You are a man of good character and are responsible for the support of your wife and two young children. You are an upstanding member of the community and have been working for a number of years. “On the basis of plea and your own circumstances, I have taken the view that sending you into custody would not be right.” |
