"Cabbie" accused of assault loses fight for licence


A TAXI driver who was accused of assault has lost a bid to get his licence back – despite the allegation being dropped.

Bill Tin Sung Leung of Eltham Close, Bournemouth, had his combined Hackney carriage and private hire licence revoked by Christchurch Borough Council on August 7.

The council had received a complaint on July 28 alleging assault, which followed two previous allegations of assault within a year.

David Fairbairn, head of legal and democratic services at the council, revoked Leung’s licence under delegated powers, and the council declined to return the licence when the allegation was dropped.

The council was later told by police that Leung had also been the subject of a Vehicle Seizure Notification for anti-social use of a vehicle.

Wimborne Magistrates Court on Wednesday backed the council’s decision.

It also awarded costs to the council for £1,586.50.

Speaking after the court case, Mr Fairbairn said: “Where there is evidence that someone is not a fit and proper person the council’s duty is to protect the public.

“In this case, because of the number and nature of the allegations, the council considered the revocation of Mr Leung’s licence was the best way of protecting the public.

“This approach has been supported by the courts in cases like this one, where there are allegations but no convictions.”
