Council facing court over wheelchair cabs


A wheelchair user is to challenge Liverpool City Council in the High Court after a committee refused to license a wheelchair-friendly taxi.
The council's decision not to license the Peugeot E7 taxi provoked a protest from some local disability campaigners and wheelchair user Alma Lunt has won the right to challenge the ruling through a judicial review.

The protesters said wheelchair users experience difficulty and feel unsafe in regular style cabs and claim the purpose-built E7 is easier to use.

Mrs Lunt said: "In the smaller passenger area of the London style cab there isn't space for larger wheelchairs to be secured and as a result many of us are bumped about, bruised and injured".

She added: "Liverpool's licensing policy is extraordinary. Detailed and accurate information, including the terrible experiences of many wheelchair users was kept from the committee, we hardly had a chance for our voices to be heard in the meetings."

A meeting of the comittee heard that "the public could reasonably be expected to be unfamiliar with the operation of sliding doors" and the elderly and infirm might find them "cumbersome and awkward".

John Bruce, from Wheelchair Users Group, said: "We are delighted that the High Court has ruled on the importance of this legal challenge for accessible transport and licensing the E7 will help remove a major barrier to safer travel and will not cost Liverpool rate payers anything."

A council spokeswoman declined to comment becuase the case is subject to legal proceedings.

If Liverpool lose this case then it won't only be the E7 that gets licensed, obviously there are interesting times ahead.

As there has already been a judgment in knowsley, this judicial review should not take long hopefully
If the review goes against Liverpool Council does that mean that London will have to comply as well :?:

Knowsley was a council decision Skippy, it didn't go to court. This one might not even run to a full court hearing once Liverpool council realise the impact of losing but I hope it does.

My Mistake lol
But Liverpool council appear to be a law unto themselves so a court case could be the best option but would they take any notice of it.
As these cases seem to take forever for a judgment it will be well into next year before we here anything

We are still waiting for the European laws to be announced and they where due in September this year

following these things to the ultimate conclusion does it mean any group with any special requirements can force a council to add a new group of vehicle requirements to its spec sheets?

whilst i am sympathetic to the disabled sometimes i feel unreasonable demands are (possibly) being made, if a newer bigger faster wheelchair comes out will it be the baseline for WAV's?

there should be guidelines as to what constitutes a "wheelchair" surely?

either that or we better all change our vehicles now...............

and another thing, it is all well and good saying what vehicle is allowed, who supervises driver training for the loading/unloading of wheelchairs?

HASAW would have a field day if the wheelchair ran off its ramp or the driver/passenger/escort had an accident whilst loading/unloading.

I suppose it's all down to the tone of the message. If you invite hostility then that is probably what you might get.

If you point out the mistake without trying to belittle the person who genuinely made the mistake then hostility might not be an issue.
