Relief in sight for drivers affected by the recall of LTI’s TX4 cabs Finally, relief may be in sight for those affected by LTI’s recall and subsequent suspension of licence by the Public Carriage Office (PCO) of all taxis suspected of being prone to the risk of under bonnet fires. On 3rd October 2008 the PCO issued a Notice. This Notice stated: 1) that LTI had informed them that they had completed their investigations into the cause of the fires; 2) that LTI had identified the remedial work required to enable the affected vehicles to return to service; and 3) that because the PCO were satisfied with the remedial work proposed by LTI they would remove the suspension of licence on a specified range of affected vehicles once the relevant remedial work had been completed and the owners of those vehicles had been issued with a certificate to that effect by LTI. By a Notice issued on 27th October 2008 the PCO extended the removal of the suspension to all affected vehicles upon completion of the remedial work and issue of a certificate by LTI. No doubt once the drivers have had their suspensions lifted and are able to return to work, they can finally draw a line under the losses they have suffered as a consequence of having had their vehicles forced off the road. In some cases, this appears to have been for a period in excess of two months. Harper and Odell solicitors have taken a lead role in exploring the option of starting a class action claim with a view to seeking compensation for the losses suffered by affected drivers. They have informed us that they are currently at the stage of investigating the parties who may be held responsible for the losses and are in contact with several drivers with a view to determining the extent of compensation that may be claimed. In the meantime, Harper & Odell have been added to the Multi Party Action database held by the Law Society as the first step towards initiating a class action claim. That sounds a tad ominous for LTI and their insurers.

Not a very comprehisive website. It seems every solicitor is trying to get a pound of flesh out LTI but I warn these solicitors that in all probability in unrestriced areas only the owner of the vehicle will have a claim and not any additional driver. I therefore imagine that LTI will request evidence of earnings from each applicant before they come to any agreemeent on compensation. Regards JD |
