Government loses Article 50 court fight

Parliament must vote on whether the UK can start the process of leaving the European Union, the High Court has ruled.

This means the government cannot trigger Article 50 of the Lisbon Treaty - beginning formal discussions with the EU - on its own.

Theresa May says the Brexit referendum and ministerial powers mean MPs do not need to vote, but campaigners argue this is unconstitutional.
The government is expected to appeal.

The prime minister has said she will activate Article 50, formally notifying the EU of the UK's intention to leave, by the end of next March. This follows the UK's decision to back Brexit in June's referendum by a margin of 51.9% to 48.1%.

The EU's other 27 members have said negotiations about the terms of the UK's exit - due to last two years - cannot begin until Article 50 has been invoked.

BBC assistant political editor Norman Smith said, if the court's decision is not overturned, there could be "months and months" of parliamentary hurdles ahead.

The government is expected to appeal against the decision, with a further hearing to be held in the Supreme Court.

this is ludicrous why do we need to pass an act of parliament to repeal an act of parliament ?

it will make us the laughing stock of Europe all so some silly woman running a "campaign group" can impose her version of democracy on parliament

They are all on the gravy chain and proves what the population want they will do what ever it takes to stop it happening or delaying the process.

Anyone in an Elected position who go against the will of the people in this instance should be voted out at the next election,again the Courts have made a decision in favour of a minority who could only go there in the first place because of the wealth they have acquired at the expense of the workers of this kingdom who have seen their rights eroded over the years.

The supreme court will laugh at it and throw it out. It's just MP's who are p!ssed off because the UK voted Brexit.

The simple answer to that is Yes. The Government have to pass a repeal act to repeal the act that took us into the EU. That has always been the case but that is not what the court decision today is about.

It was the High Court that it was heard at, thats the highest court in the country...

I don't know if I have understood this correctly but was the court ruling about the exit procedure? Meaning that parliament have to agree the exit strategy. Or could this decision mean that if enough MPs keep voting against any exit strategy we can never leave?

I would interpret it to mean exactly the above - Yes.

Obviously I have not seen the judgement, however if the reports are accurate it would seem that the politicians will be able to talk points to death - and then throw another spanner in the works if they do not get their own way. In the meantime the Stock market will carry on the scare tactics, niggling away at those who can see no further than their nose, who if they care to look,would be able to see what history has already dealt us when we were outside of it for thousands of years........managing very nicely =D>

and that highlights just why we need to get out the EU.....

fook europe, they dont rule us, the 1 shining light is that UKIP has a good base within the EU parliament

so just as Wallia has held up the Canada-EU trade deal for SEVEN years we can cause major disruption...
