Tameside has decided to issue five plates by ballot in line with their survey results. There is a concern over the way this decision was arrived at and it is being looked into. In the meantime one of the criteria for applying for one of the five licenses is that you must be a badge holder. It should be noted that this condition is illegal because they cannot discriminate against anyone applying for one of these plates by stating they have to hold a Taxi badge.

Placing conditions on hackney carriage license applications outside those cited in current legislation is unlawfull, as per Cannock Chase v Alldritt.

If anyone has any reservations that they are being forced to comply with what they see as erroneous licencing conditions that are not set out in legislation. then ask your LO under what legal authority does the council rely when applying these conditions?

I really love ballots (not). :sad:

With them you have the real chance of drivers without plates staying without plates, and drivers with plates gaining more.

Still as the T&G and NTA say 'councils know best'. :sad:

Or people without a badge getting a plate/s.
