Southend has just changed its policy from quantity control to quality control and in future will not conduct anymore unmet demand surveys.

Here is the criteria if anyone is thinking of applying for a plate.


Criteria for Applicants for the issue of New Hackney Carriage Licences


1. All licences issued shall be and shall remain wheelchair accessible licences.

Applicants must::

2. Produce satisfactory individual Inland Revenue Tax calculations for three years.

3. Have had three years driving of licensed Hackney Carriage or Private Hire vehicles within the Borough (initially full time, but see 9 below).

4. Live within the Borough or within 3 miles by road of the Borough boundary - Preference will be given to Borough residents.

5. Not previously have held a Hackney Carriage licence.

6. Not be a proprietor or have part ownership in a Hackney Carriage licence.

7. Must undertake to transport mobility impaired passengers at their request whenever not already hired by another person. (This requirement will also be a condition of the licence if issued.)

8. Not previously have had a Hackney Carriage/Private Hire vehicle driver's licence suspended or revoked and not have received a written warning.

9. Satisfactorily comply with the above, if so then licences will be offered on the basis of longest serving full time drivers (if not enough numbers are produced by this method, longest serving years of part time driving).

10. Current part-time drivers, upon issue of the licence, must become full-time Hackney Carriage Drivers earning their living wholly or mainly in the taxi trade.

I wonder how they plan to enforce that one?

Whats full time?

7 days a week, five hours a day?

Five days a week, 9 hours a day?

How can you prove someone does'nt do another job?

Will there be a lack of cabs on a Friday Night now the part time guys are effectivley banned?

I think you will find that most of the criterias used by licensing authorities would not stand up in a court of law but it all comes down to if you are prepared to back your own judgement against theirs in a court of law?

I didn't think it would take long for someone to comment on this criteria.

No 2 what tax calculations got to do with the council

No 4 That can't be enforced as there is a court case from long ago in our area that opened it up to anyone from any distance away

No 10 another as No4 [court case to allow you to have another job,] plus I don't know how some of these drivers do it, I'm to knackered to do anything else, that includes washing up, we have one or two who have proper jobs and do taxi driving as a top up

So if you are about to drive off from the station rank and a raspberry hails you, you've got to stop and turf the customer out??

I've not taken much notice of provincial councils until JD posted this. My god who runs these licensing departments?

lol I think some of these councils are engaging in competition to see who can come up with the best hard core criteria. Maybe the next council who removes quantity controls will come up with an all male policy, or over 50's only? lol

Maybe one or two of those conditions could be viewed as legal, which begs the question what sort of a legal department have they at Southend.

But as the NTA and T&G said, 'councils know best'.

I was thinking Cannock Chase v Alldritt might be a good reference mark for anyone wishing to test this criteria? It has to be one of the best criteria yet published? lol

There must be a queue the length of Southend pier of potential candidates for new licenses. That's quality control alright.

Oh right, must have at least 3 yrs driving a hac, but not held a licence before.

Sounds lke our LO has been moonlighting in Southend

I should start to worry about Eastbourne's legal department, and, whether Eastbourne council and councillors know best. Do keep us posted. I wonder how many 's you will put up then? >or<?

No council knows best. That includes the ones that have de-limited, and the ones that haven't (just yet).

And in time councils wont have a choice. As I said, you are all doomed.
