A personal view from John Davies on who should be held accountable should Edinburgh City Council deregulate taxi numbers. Please feel free to distribute these comments as you please.

If deregulation of Taxi numbers ever occurs in Edinburgh then in my opinion there are two reasons why. The first reason is obviously the intransigence of Edinburgh City council and their total disregard for the law and the second is the online Taxi forum named Fastblacks which for some considerable time was administered and run by Mr Alan Gladstone.

Mr Gladstone and many of those who subscribed to his forum taunted and goaded the current applicants into pursuing their aim more vigorously than they might have done if Edinburgh council had abided by the law and issued licenses inline with current legislation.

If the Edinburgh Taxi trade ever need answers to how and why deregulation came about then they need look no further than these two entities I’ve mentioned.

I think the experience to be learned from all this is never to misjudge the resolve or competence of others.

Perhaps a stark reality is dawning in Edinburgh that councillors are the victims of their own strategic incompetence but it all could have been oh so different if Edinburgh council had abided by the law in the first place and the Fastblacks forum under Alan Gladstone had been a little less condescending to those who they treated with contempt.

The motives of the people who are challenging Edinburgh's policy are irrelevant. No court will take this into consideration. The courts are only interested in the legality of the case. They have consistently found Edinburgh's policy to be illegal and will very likely do so again. It doesn't matter who applied to the court. The conduct which will matter is that of the council. They have refused to issue plates for years using insufficent demand as justification. If there is no demand why are plates being traded for ridiculous amounts of money?

I am in no doubt that my assessment is deadly accurate.

Edinburgh council under no circumstances wanted to issue licenses to any applicant even though they were legally obliged to do so under current legislation. They tried to bankrupt these applicants by subjecting them to appeal after appeal but If they had issued the licenses accordingly then they wouldn't be in the situation they are in today.

The gloating and goading from the Fastblacks members against these applicants reached a hiatus after the perverse decision of Sheriff Mackie in the case of 3maxblack, it perpetuated for months afterwards and was only silenced when the Court of Session delivered its verdict on the issue.

It was then that you and your colleagues were eventually silenced and introduced to a rather large helping of Grandads humble pie.

You guys scoffed when I said after the 3maxblack case that Edinburgh council would never win another case against these applicants, we now know from history that my comments were precise. However, if the Taxi trade in Edinburgh ever want living proof that it was your goading and gloating of these applicants that spurred them on, then I am that proof.

Perhaps in future you and your colleagues might wish to consider the consequences of your actions because you have already been taught one almighty lesson and if Mr Taylor wins his appeal of which I am most certain he will, then people in the Edinburgh Taxi trade are going to be asking some mighty awkward questions of you and your colleagues.

You have a very short memory JD, After the first day of the court case when first reports looked as if it wasn't going salteri's way, you where quick to distance yourself from it claiming if I remember right, that they should have spent money on a good lawer !

To late ! they already are, questions like
Where does he live ?
What car does he drive ?

You see JD ! up until recently three quarters of the trade didn't know Taylor existed, but the recent article in the evening news fueled by his comments about a drivers wife, they know who he is now and its beginning to get nasty on the ranks.

But who cares ! especially when you live a couple of hundred miles away !

Ross, tell them if anyone wants to get nasty I can’t wait. I would love to make an example of some stupid as*hole that thought he’d bought a “business.”

The fact is if they did buy a business’ they will still have it after de – restriction. The only thing that will have change is that drivers will have a choice to own or drive. I don’t remember anyone buying an inexhaustible supply of drivers as part of the plate package.

As for Milne and his wife, you tell them it was me that made the posts and I invite anyone out there with balls to look me up.

I’ll give you nasty you little pric* Brydon, if they really want to see what nasty looks like point them in my direction and tell them to come tooled up.

My advice is always to obtain legal representation if you can afford it. The comment was made by me because of a false report on the day’s proceedings which brought about my worse fears that any representation is better than no representation at all. However the advice to engage a legal representative is sound advice and there is no substitute for having a presence in court. However the end result is all that matters and the court was unanimous in confirming my submission that awaiting the results of a survey was not a good reason for an extension of time. A strong message has been sent to all council in Scotland that only under exceptional circumstances should an extension of time be granted and awaiting a survey is not one of them.

I hope you guys on Fastblacks still have the submission that Gladstone stole from TDO because every time you read it, hopefully, it will remind you of what you helped to achieve.

I don't know what they would have done but CEC were wrong to deny them a license in the first place and if deregulation happens in Edinburgh then CEC are to blame along with you guys who didn't have the foresight to see that your taunts and jibes only made those involved more determined to succeed.

I think you should face the facts that you were only too happy to support Edinburgh council while they were in the ascendancy but now the situation hangs precariously in the balance your attitude has changed. If you hadn't been so sure of yourself and Edinburgh council had done the right thing in the first place then I would never have got involved in this issue. But the fact is, that councils shouldn’t be allowed to walk all over the little people just because they have an open cheque book.

It's people like me who fight for little people like you and some you win and some you lose but you don't stop fighting just because a bunch of cab drivers on a website don't want you to succeed.

Jim Taylor has a human right to apply and be granted or refused a license but because of Edinburgh councils intransigent policy of restriction he new that his application would be refused before it was even submitted. However, he is also smart enough to know exactly what is required in order for his application to be successful and what’s more he's done it all by himself with practically no help from me? So he is to be congratulated because he has done an extremely good job and I for one hope he succeeds.

So those are my thoughts and if you think I played a prominent role in assisting those applicants to obtain a license then you better reflect on what might have been if Edinburgh council had done the right thing in the first place instead of listening to the baying mob who really didn't understand the determination of not only the applicants but those who assisted them?

I was under the impression I was giving Mr Taylor a pat on the back for all the hard work he has put into this application. You are not a party to his efforts so how would you know who did what and when? If I say Mr Taylor has achieved this success with very little help from then that is a fact. He has my full support and that is also a fact and if I can help him in any way then that is also a fact. I'm too seasoned to be intimidated by threats of violence so save your words for someone who is more impressionable than myself.

If you can pull your head out of the old news section of Taxitalk magazine for a while, you would realise that I made the same comments several weeks ago and nothing has changed since then, so any victory will be down to James himself, with very little effort on my part.

Then again what might be a little effort as far as I'm concerned might be a major effort as far as your concerned. lol
