If a private hire driver is parked up in the street or on a car park .
Which is near a taxi rank and a night club . And a person ask's that
said driver to take them home . And the said driver then ask's that
person to phone his taxi office up to book a cab , tellin the person
when doin so ask's for that same driver over the phone . Sayin his
call sign or by name . . How does this work is the said driver breakin
the law or not .and if he is wud it also mean the office also helpin
the said driver to break the law if they gave that fare to the said
driver. . Hackney driver from coalville in north west leicestershire .

If the punter thinks that the PH vehicle is in fact a taxi, and approached the vehicle in that belief, then a court might well deem that vehicle is illegally plying for hire and/or touting.

When the booking is taken by the office if they give him priority over other vehicles in the area, then that could be viewed as an unlawful booking. But it would really depend on the circumstances at the time.

I think you council needs to do some test purchasing, and need to warn the operator.

Im PH..but I reckon if that PH guy sits in such a place on a regular basis and promotes himself in that manner for runs like that then its positively touting even though the punter was going by phone though the booking office.

However had it been a one off and he just happened to be the right place at the right time then it would be different, though he still should have advised the punter simply to phone the relevant booking office to see if they had a vehicle, any vehicle! nearby that could do the job, then that isnt touting but pre booked.
