In Dundee you have either a 50/50 split after fuel and a night to your self or a set amount each week.

Most if not all are self employed,At badge renewal we all have to give our self employed tax number.

I don,t think any operator has had a problem with the taxman because their driver is self employed .

I think the min wage should be made compulsory, that would keep the cab and PH numbers down, as not every driver could afford to go and get a cab or car, it would also be a way of controlling numbers, it would in rural areas where the earning potential is next to nothing

Itd be the drivers choice as to whether theyed be prefer to be self employed or an employee...anyone in any job could opt to be self employed if both partys agreed it. and if they opt for self employed then a minimum wage is of no consequence as whatever they take in payment for the work can be whatever they want to charge. As the business owner your only responsibilty is to have them sign an agreement to that effect and notify the tax man of their self employed status.

I know the Inland Revenue, and the Minimum Wage folks, take a different view.

This loophole will be addressed in the near future. If you drive a company van and are sent all over a local area picking up parcels you will be on salary. If you are in your own vehicle and are responsible for all of its running costs, you are by definition self-employed. The driver is also free to take other work from other interested parties. This example works equally well on the PH trade as well.
I think you should think long and hard about taking on this responsibility. The extra admin and costs are expensive. I take your point about drivers waiting around but you don’t mind them waiting on their own time do you? It’s the thought of them waiting around on your time that would wind you up.
Try to think of it like this! Your business...Your jobs....Your cars.....your radios....Your fuel...Your insurance...How can they possibly be Self-Employed as well??

IIRC a driver in our fleet was told, by HMRC, to be considered as self employed you must risk some of your own money in your trade. I think it was when he was a joiner doing sub contract work. As he took his own tools, and paid his own transport to the job, he was. If the contractor supplied a van and tools on site, he was an employee. The same ruling would apply in our trade, surely. Substitute tools for vehicle (purchase and maintenance) and transport for fuel, and it's a perfect match.

by the time HMRC decide youve had 5 drivers for 5 years that should have been PAYE and you get a bill for £50,000 in unpaid tax and stamp its too late

unless, of course, you can pay up...

think i might just stick to having drivers with their own cars and renting the radio, having a couple of my own cars was a thought for the first few weeks of the firm going live, how do you get drivers to come and work for a firm thats just started,do you have to give em endless free radio rent till were well established therfore running at a loss for who knows how long?

I would Billy saves you having humungus repair & fuel bills. Jockey drivers are always lead footed because they don't have to fill the tanks. :D :D
Just tell them you will be straight and start with 1 car and   build it they will come

You of course can still supply the vehicles, alongside the radio.

Just rent them both out at a reasonable rent and the drivers will come.
