Had a accident last night!
Driver was off so suggested I'd go on as students night so abit busy,
around 3am came back on to the club closing time was driving to wards the corner of rank its a L shaped rank and there was a ph parked on the back of the rank and when turned the ph pulled out and I went straight into it hitting its right door and wing he said his going to claim off my insurance,
but I was told that if he does I could say that what was he doing parked on the rank as if he wasnt there parked where he shouldn't be it would not of happened.
can anyone please tell me who's fault it is if he wasnt parked there it wouldn't of happened so guessing its his fault?

So if the other vehicle had been a HC whose fault would it have been?

but What was he doing parked on a taxi rank
Touting/illigal plying?

Yes, you did mention that in your intitial post.

What I was trying to do was ascertain the facts as regards the driving, not what kind of vehicles they were and whether or not they should have been there.

I had an incident a few years back where I hit a vehicle that was parked on double yellow lines. The insurance said it was my fault. It doesn't matter that the other vehicle should not have been there. I would just fill in the insurance claim form and let them decide.

Those assessing who's at fault will not give a stuff about the PH parked on the rank.

If you could have avoided hitting the car, then you are at fault, if not then you're not at fault.

many ranks are on private property and are little more than a few strips of paint, i worked one (as a hack) every friday night there was a flash BMW turn up full of blinged up R&B boom boom boom lads with baseball hats on the wrong way, the LA and cops said they had no power to move them on as the rank wasnt on council land.....

So let me get this straight, First ****hole wants to try and wriggle out of blame cos he thinks the other driver shouldnt have been in hes way..... Second ****hole says to first ****hole "blow the driver who shouldnt have been there up to licensing".....

if you use the dollar thingy (its on the number 4 button on my keyboard and I guess yours too) you'll save yourself a few star thingies.

Incidentally, it's attached to my byelaws to advise the local authority of accidents.

(by the way ar$ehole isnt a term of endearment).

don't worry
Im going to get him done for touting there's abit of evidence on the clubs cctv he was parked at the back a hour before few people walking to the taxis then walked towards him and he took off came back did the same and then 3rd time i got into his way.
Damnn private junkies begging people for fares!!!

Yes, I think the highlighted bit is the part you want to get the CCTV evidence for to show to your insurance co as evidence :badgrin:
