Location: City of dreaming spires
Someone I know has according to the police driven through a red light whilst they were behind him, instead of pulling him over, they have reported it to taxi licensing who in turn have given the driver a written warning on the word of the police.

The driver did ask why he was never pulled over, apparently the police were on there way to the station, is it worth an appeal, if so on what grounds, or should he just take the warning?

Any advice welcome as always

Apparently the police van was behind him at the junction and he can't remember going through them..

If it was a police van it is unlikely it was fitted with video and the officers probably don't have the specific training to enforce traffic violations (they'll try but it's a loophole that can be exploited in court), a lot of it comes down to their word against yours.

There are procedures that have to be followed precisely in order to prosecute, why wasn't a ticket issued at the time, did the officer make a record in their notebook, what supporting evidence do they have, were the lights checked for faults, does the officer have the required training - all of this counts in court.

I'd say if they met all the requirements they'd have prosecuted, by not doing so and instead reporting it to the council they probably don't, how the driver proceeds is up to them but get legal advice first.

I'm not sure it's worth doing or saying anything further at this point, other than suggest your colleague gets front facing CCTV.

Should this be brought up at a later date then questions will need to be asked.

As you say if police officers in a marked van see someone jump a red light then it is them that should pursue the driver, not subcontract it to a civil servant.

However IMO it's best left as it is.

Your LA seems to keen to reprimand this chap when he has not been charged with any chargeable offence.

No chargeable offence should imply he as yet done nothing that would merit a written warning, Ask the Council to prove an offence has occurred and which would merit such a warning and if they cant then he should have their written warning rescinded.
