I have read that judgement but it doesn't seem relevant to the situation that I am referring to which is nothing to do with the un-plated vehicle that we had or another company operating vehicles in our borough but plated in another but is to do with our Council being able to charge fees when the did not adopt the LGMP act correctly in that they did not send letters to the parish Councils and did not advertise the adoption of the act in the newspaper.

Not sure 'by the balls' is an accurate assessment Mr TT, but Grandad has raised serious questions.

The issue re license fees/legal adoption of the 1976 act, is a matter of fact, they either did it or they didn't.

If they did then there should be some evidence of the legally require advert, be that a copy in the local press as required, or maybe even a copy of the invoice that paid for the advert, or a bank statement showing the fee paid for the advert.

If Grandad has checked the press for that period, and no advert appears, then he has a good chance of succeeding.

But it's not going to be plain sailing.

Hull could not prove they had adopted the 1976 act, so there was no case to answer, it's just more evidence that they have to prove they have adopted it correctly. I think he's saying this case is more evidence in your claim against melton.

Silly me, I should know by now that you have to read these things to the end. Why didn't the judge just start with the 3rd paragraph from the end and just leave it at that.

It would be good if judges said right at the beginning what their decision is, and then outline the reasons behind it.

There are some whopper judgement that I've read that I have changed my view of the outcome numerous times.
