Plying for hire without a proprietors licence presumably? So it's down to "the proprietor". Is that the proprietor of the car, the operator, the driver or the registered keeper? All could be different. :? Define "proprietor".

Hackney carriages do not have operators. The license holder is my wife. The registered keeper is the Company and the driver was an employee.

What would be the case regarding a hackney plated vehicle that was currently working for a local private hire firm and working the hackney council allocated ranks , that used a private hire firms meter rate (which is higher than the local councils hackney rates)

Re section 67

Charging more than the meter fare when HC(V) used as private hire vehicle

Level 3 ????????????????????????

Hope I explained my question correctly

The trouble here is that the car wasn't plated, the plate had expired! to work as a ph it would need a ph plate, simples.

If it is a hackney working within it's own district, it has to use the meter calibrated to the council hackney fare.

It wont be a judge, but three commoners doing their duty.

It possibly wont be any of those depending on the council's enforcement code.

I have had a call from the enforcement officer this morning. The driver has been offered "words of advice" And my wife will be receiving a written warning.

A sensible outcome, and I suspect in line with the council's enforcement policy.

I would suspect the council knew what was coming, and didn't want baffled with science, by all the FOI requests
