Whats the law on this?

Our lad works 35 miles away from here/home (PAYE, not taxi...thank god)

he started at 6am today, finished at 2pm, got back here at 3pm

at 4pm work asked him to go back in, so he got back at 5pm, he reckons if he finishes by 10pm he can be back in legally at 6am tomorrow, he wont get back here till 11pm after going out at 5am.

he wont tell work no, he needs the money but that wont help if he nods off at the wheel on the M6 or his car blows up will it

Law says there has to be 11 consecutive hours rest in every 24 hours ;

"In general the Working Time Regulations provide rights to:
•a limit of an average 48 hours a week on the hours a worker can be required to work, though individuals may choose to work longer by "opting out"
•5.6 weeks' paid leave a year
•11 consecutive hours' rest in any 24-hour period
•a 20-minute rest break if the working day is longer than six hours
•one day off each week
•a limit on the normal working hours of night workers to an average eight hours in any 24-hour period, and an entitlement for night workers to receive regular health assessments."

It's not THE LAW, the law provides rights to. If the employer denies the worker those rights, the employee could have a good case under the Working Time Regulations.

An employee is quite legally able to op out of the working time directive, but should not be penalised for not wanting to opt out.
There are some industries that an employee can't opt out of the WTD.
Workers who can’t opt out

Employers must not allow the following staff to opt out:

workers on ships or boats
airline staff
workers in the road transport industry, eg delivery drivers (except for drivers of vehicles under 3.5 tonnes using GB Domestic drivers’ hours rules)
other staff who travel in and operate vehicles covered by EU rules on drivers’ hours, eg bus conductors
security guards on a vehicle carrying high-value goods
