Last Friday a fellow driver was up in front of the licencing committee for a number of motoring offences
The licensing officer was after his badge or for him to be given 3 months.

The licensing committee gave him 30 days suspension

In front of committee the driver asked if its possible to start suspension now with out appeal as the court will not overturn motoring offences.

Now the L.O. said this is not possible as he has to wait for his letter of suspension and given 21days appeal effectively ( Happy Xmas Not    )

Now for the question just before his appeal period expires he state,s he would like to appeal Allowing him to work the xmas and a week before the court case decides he no longer wishes to Appeal is this possible

And how would the courts view it ????

I don't think it matters how the court view it. I would think he is within his rights to enter his appeal and then withdraw it at any time.

If someone withdraws an appeal the courts couldn't care less.

He may be liable for the council's expenses up to that date, so the sooner he withdraws the appeal the better. If he chooses to.
