My interpretation of touting has always been i.e as some do: "taxi love"/verbally inviting/asking a member of the public....do they want/require a taxi. In a case of someone approaching a driver, then I would argue that it is not touting - unless you are putting yourself into such a position i.e say outside a night club.

The other thing that might crop up is the argument of NOT having an operators license! but do I as an "Independent" driver come under those rules ? my reasoning being is that I do take bookings as an "Independent Hackney" from passengers to pick them up............without an operators license Or am I considered to be an all in one "Independent Operator"?

You have had opinions from members on here but the only opinion that counts is the opinion of your LO. It is they who ultimately decide if what any of us do is likely to be within the law and if they think not they will prosecute. Simple really.

Seems a strange reply, you know full well LO know nothing, they only think they do. They give out false information on a daily basis.

If his LO says it is ok, then it is ok because they will be the people who will prosecute. If they say it isn't ok and you still do it, rightly or wrongly you are asking for grief.

So we can all pick up illegally anywhere, so long as it's not in our own licensing area, which is the only place our LO have powers?

If someone from another town is picking up illegally in our town, we report it to our LO. they pass the details on to the LO where the vehicle is plated and it is up to them to prosecute. Well that is what we are told.

It is not always opinions that we are after, this is a pretty knowledgeable forum that often comes up with the "Right" answer.

To say it is the opinion of our L.A that counts is as Mancityfan points out B.S., as they regardless of opinion have to adhere to the law. What I was basically looking for is........... the answer to what is the law of the land, the law that does not always cross the t's and dot the i's.

All I would in my opinion get from the L.A is the goody two shoes answer - not always the right/truthful answer as Mfc points out.
