School runs or not.

A local taxi driver who had a school run was involved in a accident. his Car want off road for a while.

He stupidly decided to take the kids to school in his own car.
I am not sure how many times, but I think at least for a week.
He has told me that the LO has sent him a letter saying he will be brought in front of the Licensing committee and has been invited to attend a meeting with the LO.

He has told me that he did not invoice for any runs while he drove his own car and he intends to say that he was doing it as a favour to the parents of the children he takes to school...not sure how the LO will take that??

Its a stupid thing to do, he now knows that.

Whats the likely result of meeting with his LO end of this week and the committee?

Anyone know?

Did he inform the council that the work was for that he was using his own car whilst his was off the road? If he did and they cleared him to do so he may be ok. If he didn't inform them then he will probably loose the contract and possibly his drivers badge.

No sadly he did not.

Can the local LO suspend his badge this week, before committee?

He has broken the law, both council and criminal.

I suspect he will face sanctions from the council (operating unlicensed), and maybe from the police (no insurance).

Ive had car problems, all i did was sub the run out, i may not have made as much but it was all legal and above board, operators must KNOW the rules, why bother breaking them?

going into a contract with no backup plan is madness, the operator could have even passed it back to county to get cover while his car was laid up.......silly boy

Yes, that's the case I was thinking of. Because he would receive pecuniary advantage, it's still classed as hire and reward even though he didn't charge. His insurance would be null and void irrespective.

I suspect he'll lose his badge over this unless the LO decide to take him to court.

Thanks for the reply lads, I think he thinks he will get off, looking right now I doubt he will. He is a self employed hack, no back ups, but oddly enough if one man bands can't do school run for what ever reason, the home to school transport have always obliged and helped out without penalty.. I guess he has well and truly messed up.

WOW.....you mean he didn't actually know what he was doing and membership of your union would have ensured he was adequately educated so the situation wouldn't have arisen?

surely a union or even the NTA would have ensured he new his legal requirements and the risks and penalties likely for illegal activity

The contract would have told him his legal requirements. He chose not to follow them and got caught. No union or association would have been able to stop him from doing it.
