our council licence conditions clearly state for private hire vehicles

"the holder of a private hire car operators licence shall not display or permit to be displayed on or in their private hire car ( other than on any taximeter fare dial ) or on their person the word "CAB" "TAXI" or "FOR HIRE" or any word or words which might give the impression that the vehicle is plying for hire."

this i am told is an extract from the civic goverment act ( scotland ) so applies to all scottish council licensing areas

however i don`t see how that stops someone naming theirselves ABC TAXI`S they just couldn`t legally up here anyway carry company cards or signage in or on the private hire vehicle or their person ( regardless if they had owned taxi`s ) stating ABC "TAXI`S" or "CABS" they could however carry items stating just ABC or ABC CARS or ABC PRIVATE HIRE etc etc and still be listed in the yellow pages,advertising in pubs,clubs,maildrops etc,etc as ABC TAXI`S i don`t see how the law could stop that only on or within the vehicle is the law applied

anyway the law is flouted by our council as another condition they state is i must wear at all times my council drivers badge while in charge of a licensed vehicle and if at the time i am driving a PHC my badge states the word "TAXI" driver :lol: ( which allows me to drive both taxi & phc ) the council tarrif cards displayed in my private hire cars state "TAXI" aswell :lol: so that qualifies as on or in the vehicle or on my person :roll: :lol:

Civic Government Scotland Act 1982

Signs on vehicles other than taxis

14(1) Subject to subsection (2) below, there shall not be displayed on or in a private hire car any word, sign, notice, mark, illumination or other feature which may suggest that the vehicle is available for hire as a taxi.
(2) Subsection (1) above does not apply in relation to any licence plate or other thing issued by the licensing authority for the purpose of indicating that the vehicle to which it relates is a private hire car or in relation to any sign required by virtue of section 21 of the Vehicles (Excise) Act 1971.
(3) Any person who -
(a) drives a vehicle in respect of which subsection (1) is contravened; or
(b) causes or knowingly permits that subsection to be contravened in
respect of any vehicle, shall be guilty of an offence and liable, on summary conviction, to a fine not exceeding £1,000
.

ahh so that covers my council issued items,that clears that part up :wink:

just saw that mate as replied to above thanks all cleared up only had my council licence to hand i have a copy of the act somewhere but not seen it for ages or i would have checked that cheers

years ago when i went mixed taxi / phc ownership i changed my company name to end in RADIO CARS instead of TAXI`s and adjusted all my company livery,cards,advertising,yellow pages listings etc etc accordingly so that i could display the same company name on all the vehicles regardless of taxi or phc end of further confusion with the company advertising at least i felt and i have ran this way ever since

it still didn`t stop the public trying to flag down a phc car and i think nothing ever will the public don`t understand the difference really or care for that matter it is up to the person in charge of the phc vehicle to conduct himself within the law properly end of

Can the phone be answered 'ABC Taxis' and then the job be allocated to PHV on the same fleet?
