I think it is something to do with them. They have a responsibility that work they contract out is legal, in that it does not break Minimum Wage Act regulations. If it does, then the contract becomes outside of English Law, and thus unenforcable. That is my reading of it anyway.

The issue, is how we get them to accept this, and understand that they are making things worse for all of us, themselves included. It will probably take a serious high profile accident to happen, to bring everything into the media, before they accept they are doing something wrong.

Telling them, is like talking to a brick wall.

Nope. At least with a brick wall, you don't have to listen to silly answers.

the problem is that work is scarce, so some bids are at below break even level, i dont bid below what i want/need to run the car, and an escorts wage WHILE IN THE CAR, not 1 way, cos they are "needed" from base back to base, however i get the distinct feeling escorts are doing it cash in hand, and some vehicles are below par, i certainly see minor rule transgrestions every day, drivers/escorts with no badges, some smoking in cars, exterior signage missing or non-compliant, i even saw a 2.7 tdi audi saloon monday with a square rear number plate and the space next to it empty, no plate

if LOs cant be arsed to get OFF thier arses and out checking then certain operators will flount the laws and can bid cheap, some must be runnin on red looking at some results, or using unmaintained vehicles

county council transport staff should do spot checks at the bigger schools to check compliance, i know 1 where about 40 plated vehicles arrive daily

What's the choice?

1. Operate illegally? ---- maybe
2. Reduce costs by reducing vehicle maintenance? --- Im DIY anyway
3. Don't bid on Council Contracts? - see 6 below
4. Work for nothing - just for the joys of the job? --- as if
5. Go Bankrupt? --- been there....
6. Go on the dole? --- been there too, not that bad actually
7. Bash head against wall and end up in hospital? --- MRSA
8. Ring Samaritans. --- they hung up on me

Do The Council, not have a Duty of Care, to ensure that contracts they award are legally operable? --- No

Is it not the case, that a contract awarded that cannot be operated legally, is in fact a void contract and cannot be enforced under English Law? --- under common law a contract should have "advantage" for both parties (1 question on a CPC)

the lowest bidders win, which sometimes seems the stupid option...

what about "escort should have 1st aid certificate and be versed in CPR"

Just about sums it up.

Also councils are having to cut back massively on all it's bills. If they don't then there will be loads more job cuts.

So if it's a toss up between screwing us down on price, or losing their jobs, it's tough s*** for our trade.
