Wrong in this case, if he felt she was refusing to pay the police should have been called

Your argument is flawed, the passenger had a contract (verbal) to be conveyed along the regular route (as normal) not through some (illegal?) yard with gates at the whim of the driver, doubtless he would have wanted the regular fare for the shorter route, seems he got it wrong and might yet feel the full force of the law and public opinion and his base could kick him off...

If you took a passenger down a toll road on YOUR whim/decision would you add the toll fees to the fare?

I put forward 3/4 possible scenarios.........try to keep it in perspective ole chap.

you compared the victim to a shoplifter

i doubt that would hold up as a defence in court

Either way it is theft.

nothing was taken, passengers never left the car, the driver is looking at 12 months porridge or more with luck

Let us try and put this to bed as it is out of context. In this instance it would appear that nothing was taken. The question was asked of "Their" not "Her", that to me is a general question.

Has holding someone against their will got legs on this?

My take is this.......if someone is trying to steal or deprive a store of its money - can they hold that person against their will! Of course they can.

But the driver inflated the fare by taking an unusal route , he cocked up and hes the one that will pay now, in many cases a woman in a taxi that ends up blocked by a locked gate could be expecting a sexualt attack, is that part of your shoplifting scenario?

might be best if the driver left town for a while

The driver is about to feel the consequences and lets see how that pans out

Its pretty obvious (to the sane) that he GOT IT WRONG, instead of the usual fare for fewer miles, he ended up MAKING A FCK UP and may just have cost himself his job (at least) or his clean criminal record (LETS HOPE)

The Industrial estate may even have been private property (sounds like it with gates being locked) so that kidnap, extortion and trespass!

Quote:
Last night one of our drivers was sent on a job to pick a regular customer up, when he picked her up he went a different way to what she unusually goes, he went through an industrial estate only to find out the gate at the other end was locked, he then came back on himself and went a totally different route making the fare more expensive, she knows the price because she has the job regular.

What he SHOULD have said was "oh sugar, the gates are locked, dont worry the fares the same" and walked away with his life intact, greedy ba5tard

If you get something wrong who pays, you or the punter?

It has already been answered #-o....When I said he takes the hit, I did not mean punch/slap/kicking  - "The hit", like out of his pocket e.g he loses the money/he charges the normal fare/she loses nothing

Quote:
She was telling him all the time that he was going the wrong way.

Then he takes the hit - no question.

The gates are on private land and are owned by Taylors Transport.
