yes, that's how I read the law too - the thing you point to which is highly instructive is the VAT - all taxi fares a VAT inclusive - I would wager if it ever gets to court a court will conclude the sample principle applies to card charges.

You are not charging the punter any more for the taxifare...he is being given the opportunity to pay in a different way ..if he wants to..his choice...

The driver only gets the fare, the passenger chooses to not pay cash and so incurs a bank charge - pay cash, no bank charge.

What would you wager CC, I suggest a Lady Godiva and the money to charity of the winners choice. We just need someone to go through the Courts with it. It could be a while before the RNLI get your fiver.
