So I considered that the Council had "Entrapped" me and others into over-ranking by telling me at Trade Meetings and the Trade as a whole at the PLTA AGM that four or five (on Whimple Street) was OK when the Rank is flowing or moving. They then nicked me for doing so.

I looked around, starting with NALEO's "The Book" and soon found case law in the form of "R v Loosely". Available here http://www.publications.parliament.uk/p ... oose-1.htm and I wondered how to deal with it.

I still intended representing myself, but approached a Solicitor for advice only, he advised that it was not “Entrapment” but may well be “Abuse of Process” or “Breach of Promise” and strongly advised retaining a Barrister.

So the Barrister suggested that the relevant cases were “Regina v Adaway” and "Postermobile v London Borough of Brent”, both of which I will post in the “Court Case Database” on TDO.

I have hardly scratched the surface, you have lots more to come, consider it an on going saga. It is going to take ages by the look of it.

You will get some relevant case law, that I will post at the required time, about abuse of process, breach of promise and even entrapment. It did not succeed in helping me, it may yet help you.

I would suggest that, using your smartphone or a Dictaphone, you record all meetings (or encounters) with LO's and Police etc. starting right now.

Chris been indisposed for a bit just started reading through this and i aint a lawyer :D

your advice here is bang on!

My advice never ever represent yourself. An expert in the field Lawyer would be my advice paid for by your Union of course.

I hope you resolve this issue to your satisfaction.

Are you getting support from your fellow Drivers and are they prepared to assist you on this occasion :?: :?:

I freely admit that prior to my reviewing the recording I was not aware that it was actually stated at the AGM. It is possible that I had left the room at the relevant time to check that the subsequent guest speaker was comfortable, this being a duty for me in my capacity as Vice-Chairman. The recording does clarify the stance taken by Mr Netherton on behalf of the PCC. Permission for what I did was granted, enforcement action would not follow, Licensing Officers had been told.

Killer to me..

TT, I note that you have not read the very first Post in the thread!

If you had you would know that I got a discharge, £15 Victim Surcharge and £2,000 costs against me. You would also know that I have lots to put up on this and, when it's done I will let you know. It did not help me, it may help you or others in a similar scenario.

I am only in one Union, been married for 30 years. When I first started as a Taxi Driver I was for a short time in the GMB, but I found them to be a waste of time. I am in the local Association and therefore the NTA.

I was represented by a Barrister.

I would not want other Drivers to help me with footing the Bill and nor would I expect it.

Drivers have suggested a protest, I had to point out that a protest about me could be seen as a Contempt of Court, I have suggested that a protest with the aim of securing more Rank space in the area that this is all about would be of more use and see me joining wholeheartedly.

I will continue to put the documents up, but it is time consuming and I really am under the weather, toothache and the side effects of the Penicillin, so I would ask you again to bear with me please.
