They know what to do, all they have to do is put their hands in their pockets and have the balls to see it through. If they don't know the law up there then they should go see a good solicitor, its no good moaning about something thats in your own hands. Maybe they are all scared of being thrown off the Airport?

And that is the problem.

Those that sit around all day moaning about poor representation (or should I say, in their opinion that it is), get their just deserts when the poo hits the fan.

Take Watford, loads of huffing and a puffing, but when it comes to the crunch, nobody wants to dip into their pockets.

Some people get what they deserve.

John,
Are they doing anything legally wrong? is it right that they are directly opposite a rank and today for example a group of 8 people spotted them and walked over and got in them. If this is not soliciting then I for one do not understand why we are obliged to follow any rules and regulations.
They are operating purely and simply because the Airport is leaning on the Town Hall to look the other way.

Ged, Without laying out chapter and verse of the opinions contained within these reports, here is the best advice I can give you.

All the answers and solutions are contained within these court cases, if Airportcarz are indeed committing an offence then you will find the solution in the following evidence.

Young v Scampion QBD 21 July 1998
DPP v Cargo Handling ltd 2 December 1991 QBD
Cinnamond v British Airports Authority 1980 RTR
Curtis v Embery June 22 1872 LR
Birmingham & Midland Motor Omnibus company v Thompson April 18 KBD
White v Cubitt Nov 15 1929 KBD
Nottingham city council v Woodings QBD 22 Feb 1993 RTR 1994
Eastbourne borough Council v Stirling & Another QBD Oct 31 RTR 2001
Hullin v Cook QBD 22 June 1997 RTR 1997

Best wishes

John Davies.

John,
Many thanks for that info. I am not involved with the committee side of things any more but I will pass the case law on.
I have refrained from putting to much on here because we do not know who might be reading it.
I have stated already that in my opinion we have taken our eye off the ball and the Oft can wait while we fight this battle. Again in my opinion this has a far more serious effect on all our futures than the farce in London.

Thank you for that information Sussex but I won't be around much longer I have other things to do that are pressing, but I'll hang around until March 9th when I expect the official response from both Ministries. That will be most interesting.

I must admit its been fun reading the differing opinions from around the UK of both industries. I've enjoyed reading some worthwhile comments and perhaps some not so worthwhile comments lol. I do however hope this forum grows and grows, I'm quite sure it will.

Best wishes.

And do you think in those five years you have improved your overal understanding of the both industries? or has it remained about the same?

Best wishes

My knowledge of the trade has increased hugely, my understanding of some parts of the HC trade has increase slightly, my grammar and spelling has increased vastly, and my regret that we are a trade split in two has remained the same.

Well I think we can call that a success.

By the way, you know how certain individuals at the select committee hearing slated Rank Marshals, including our own Graham Stringer the Manchester Blackley MP, along with Mr Efford and our man from the T & G Mr Kavanagh. Heres what a very long standing and hard working prominent member of our own Taxi Trade and GMB member had to say when they were first introduced in Manchester before xmas. You may find his comments at odds with the people I have mentioned above. It just goes to show what a real cab driver thinks about Marshals. It may make you wonder why the three protagonists mentioned were so hostile to the OFT delegation over the introduction of Marshals.

Perhaps MP's who sit on select committees should also be made to take the knolwedge? That would be interesting.

A council has to act reasonably if its unsafe for you its unsafe for private hire, added to this its established as a public hire space so the council are in effect turning a blind eye to breaking the law and benefitting.

on the last point you should aquire the help of an expert, be it a retired LA engineer or Administrator.

write to the director of public prosecutions, and report the matter

if you want help with this find this sites memberlist and pm Paddington Bill or Yorkie.

Complaiin to your ward councillors in writing, sending a copy to both your MP and MEP. IF YOU ARE IN sCOTLAND OR wALES your SMP or equivalent

also write to your councils chief executive and complain and mention that you are mindfull to contact the local government ombudsman.

write a seccond letter to your MP and ask them to pass it onto the transport minister.

if you want help with all this pm paddington Bill or Yorkie on the member list who will get the facts and draft you letters.

you are being bullied and you are right to ask for help.

There is no law which allows PH to rank anywhere, they are to return to base after every job, unless going straight to the next job. With regards
supermarkets the same applies, if the public have access to private land then they are not allowed to park there.
