Firstly, he is within his rights to lodge an appeal against the Council, in the meantime the Council must give him his badge until the case is heard. If he's proven guilty then fair enough take his badge.

I think until he is charged with an offence, then the council is highly unlikely to justify to a Mags Court a suspension.

I think the best bet is for the police to charge him, if they have enough evidence, and put a bail condition on him that he doesn't drive a licensed vehicle.

If the police haven't enough evidence to even charge, then the driver should be left alone.

Not saying that's right or wrong, but a number of false claims are filed throughout the country, and we really are innocent till proved guilty.
