For the majority of our work we could badge and plate as hackney in Rutland and then the drivers could work through our Private Hire License in Melton. We already have some cars that are purely private Hire and only do bookings.

Why would you leave it to the last minute to renew when a DBS is due anyway?

well whats the max for the county court - put the Lo's name on the claim and the chief exec and this thing will be sorted within 2 days

That's true, and if he was wearing a seatbelt he wouldn't have gone through the windscreen.

The point is, what you write will be taken into consideration in respect of the drivers claim.

The facts seem to be, the driver applied for the DBS, the driver has a record with the council, no history of poor driving has been recorded and the council has a discretion in law.

The law doesn't say the driver must produce a DBS - it says the driver must be considered fit and proper.

The council could have given the chap a 1 week license or a one month license, or indeed a one day license if they felt it appropriate.

I am not defending the driver in respect of what he didn't or should have done. But the council in this case are not using the discretion they have and are then hiding behind a rule - that rule therefore becomes a fetter - and the law doesn't allow for that.

Oh well I guess that's why our council issue a licence when it's a renewal whilst waiting for the results of the DBS. I was just wondering why the driver had waited until the last minute to apply for a DBS check tbh

I would suggest one month in advance, I think two weeks is optimistic

Reading all this actually makes Gloucester City Council look good!

For first applications, they expect the CRB/DBS to be present and recently issued (less than 1 month), but on renewal they like the drivers to bring their DBS form along with their badge paperwork so that all the application form are submitted/verified together. The badge is issued on the expectation that the driver has no convictions which they have not been told about. The driver then just has to show them the DBS certificate when it arrives; with CRB they would get a copy anyway. I signed up for the update service so I won't have to worry about showing them the DBS again and all my CRBs and my DBS have each taken about 3 months to arrive (my dad had a CRB done 5 years ago and it arrived in 1 week).

Part of the thinking for such a process is that drivers are expected to inform the licensing department asap if/when they have any convictions, so if they haven't then they can expect to be up before the disciplinary panel when such things come to light via the DBS and the badge issued subject to having items on the DBS that they are unaware of.

Toots, The Council send the forms off. You can't do it yourself. The forms were sent off in plenty of time, the DBS was posted to him on October 1st. It just didn't arrive before his current license expired on the 10th. The driver is completely blameless here.
