Taxi Driver Online :: View topic - booking agents- Do they need an Operators License

Can anyone help to clarify the law regarding the alocation of telephone bookings, if the booking agent does not own or operate any of there own vehicles?

What I am saying is that a company may advertise to provide a service and then alocate the work to a licened operator with vehicles. He will take a small comission.

Does the Company in question require there own operators License.

Isn't this the same kind of thing as Cabfind etc

Yes, as they are clearly acting in line with the definition of a PH operator as described in the 1976 act.

"operate" means in the course of business to make provision for the invitation or acceptance of bookings for a private hire vehicle;

Would that not mean from the word operate implies that you are operating vehicles, when it is clear that you do not own any.

The company in question also has no drivers as well.

Again we come up to the taxi, PH???? Taxi ok. PH not ok if the person doing the advertising hasn't got an ops license in the area he his operating/advertising from. Also not ok if he has yet gives/passes work to PH not licensed in his licensing district. Basically the likes of Limo Broker are not working within the constraints of the 1976 act if they pass work to cars not licensed in the area in which they take the job.

No it doesn't. The company I work for do not own any vehicles at all they just operate. All the drivers own their own vehicles or rent from somebody outside the company
