 Post subject: Clip board johnny's

Clip board johnny's ,in recent posts i have read that they are a big problem in certain parts of the country.Dundee know has one at fatsams central :evil: can anyone give any advice on how do deal with this bearing in mind this is Dundee.I have a meeting with my local MSP,MP on this subject this week.I think the company involved are trying to get round the new legislation by using a clip board johnny.

I would ask your council where in the new laws it allows a mush with a clip board to tout for PH work? :wink:

Thanks sussex ,i have got a feeling that our council are trying to find away of allowing the private hire to continue to use the yard.As i have said before this is only going to stop if we take the council to court.

If you dont make a stand now, the scabby touting bstards will be all over your town before you know it.

If your a member of a union, get them on the case (unless its GMB in which case theyll be representing the other side)

Thats good advice, ignore it at your peril, take no notice of the scab from sussex, hes after your work

Its all there in the small print, all bookings must come from an office that must be licenced if there are 3 or more cars and cannot come from anywhere else
Go and speak to the police inspector he has to act to prevent fat sams from breaking the law

It's about a number of things Skippy and the situation at fat Sam's in Scotland isn't any different to what is going on in the Chichester area of England.

The interesting scenario at Fat Sam's was the possibility of a block booking being acceptable.

Section 56 (2) b of the 76 act states;

Every person to whom a licence in force under section 55 of this Act has been granted by a district council shall keep a record in such form as the council may, by condition attached to the grant of the licence, prescribe and shall enter therein, before the commencement of each journey, such particulars of every booking of a private hire vehicle invited or accepted by him, whether by accepting the same from the hirer or by undertaking it at the request of another operator, as the district council may by condition prescribe and shall produce such record on request to any authorised officer of the council or to any constable for inspection.

I type in bold the word 'may'.

Unfortunately whilst a council 'may' make a PH operator keep records, surely by allowing block bookings a council may also 'not' do the same.

Perhaps a body such as the NTA should push the DFT towards making the 'may' a 'must'.

The London PH act is clear in the above respect.

The subject of private land is far murkier, even the glorious LTDA have had difficulty in obtaining prosecutions against PH on private land.

With rail property and airport property there are often local bye-laws which come into force, with privately owned land there is a distinct difference and lack of clarity.

That's worthy of a separate post.

CC there is no privately owned land in Scotland and no trespass laws
For example you can walk across any land you want up here as you have right of access
